Discussion followed. <br />Secretary Harris emphasized that regardless of any other review, the Civic <br />Overlay District requirements would be enforced. <br />Mr. Mark Gerton, was present to represent the applicants. <br />The Public Hearing was closed on the negative declaration review. <br />Commissioner Wood asked Mr. Levine, Deputy City Attorney for clarification <br />regarding his position, since he disagreed with staff's interpretation on <br />traffic circulation in the environmental assessment. Mr. Levine advised <br />him that if a Commissioner believes that a zoning change would result in <br />significant environmental impact to the area, then he should vote against <br />the filing of a negative declaration. He could also request the staff to <br />conduct a traffic study. <br />Resolution No. 1543 was entered and adopted making the finding that the pro- <br />posed project would not have an adverse effect on the environment and that <br />a negative declaration be filed for the case. <br />Roll Call Vote <br />Resolution: Shepherd <br />Seconded: Doherty <br />Ayes: Doherty, Jamieson, <br />Noes: Wood <br />Absent: None <br />Abstain: None <br />Shepherd and Chairman Butler <br />Application to rezone approximately 3.1 acres of land located at the southwest <br />corner of Main Street and Bernal Avenue and including all of those properties <br />lying between the City Hall and Main Street, and between Bernal Avenue and <br />the Pleasanton School District Administration Building, from the 0 (Office) <br />District and the P (Public and Institutional) District to the C-C (Central <br />Commercial) District. <br />The Public Hearing was opened on the rezoning review. <br />Mr. Mark Gerton was present to answer questions. Upon inquiry from Com- <br />missioner Shepherd, Mr. Gerton replied that he had a potential buyer for the <br />old post office building, who is Page Binkley. He also said he would be <br />willing to lease some office space in that building to the City for the <br />Police Department. <br />Chairman Butler asked Mr. Gerton for his reaction, as a longtime supporter <br />of the downtown, if he felt this rezoning might detract from the CBD and/or <br />Civic Center idea. It was Mr. Gerton's position that it would enhance the <br />existing Civic Center complex and help the Central core area. He told the <br />Commissioners that quite some time ago, the Chamber of Commerce reviewed this <br />application and gave their support. <br />Discussion took place regarding amount of office space available or lack <br />of office space. He believed that there is office space in the downtown <br />which is available and going empty. <br />Next, Mr. John Edgren, one of the owners, spoke.
