Resolution 1575 was entered and adopted approving this conditional use permit <br />subject to all conditions in the staff report and adding another condition <br />that no storage or parking of vehicles or equipment occur on the undeveloped <br />portion of the property, and subject to the required findings. <br />Roll Call Vote <br />Resolution: Wood <br />Seconded: Shepherd <br />Ayes: Shepherd, Wood, Chairman Butler <br />Noes: None <br />Absent: Doherty, Jamieson <br />Abstain: None <br />Mr. Holzer expressed appreciation to the Commissioners for being attuned to <br />their concerns. <br />Chairman Butler announced that the action taken by the Planning Commission <br />is subject to appeal within 15 days from the meeting date. <br />Z-77-147, Rodney Cowin - application for a home occupation permit to allow <br />the operation of a vending machine business from a residence located at 3855 <br />Mesa Verde Court. Zoning for the property is R-1-6500 (Single Family Resi- <br />dential) District. <br />Secretary Harris described the staff report. Recommendation is for denial <br />for three reasons (1) violates required standards for parking of cars in the <br />garage; (2) the use is not incidental to the use of the dwelling as a resi- <br />dence; (3) the use would generate traffic in the neighborhood which is not <br />typical. <br />The Public Hearing was opened. <br />Mr. Cowin spoke for his application. He indicated that about 30~ of the <br />garage is occupied by vending machines. He conceded that he erred in storing <br />some vending machines in the street in front of his home. This situation <br />has been corrected. He said a continuance would be acceptable pending a <br />field inspection by staff and/or Commission to ascertain compliance by re- <br />moval of the machines. <br />Mr. Thomas Murphy, resident across the street from Mr. Cowin, spoke. He <br />asked that the application be denied. He then related the problems he and <br />the neighbors have encountered with Mr. Cowin regarding the manner in which <br />the business is being conducted. <br />The Public Hearing was then closed. <br />Deputy City Attorney Harvey Levine read the list of conditions the applicant <br />would have to meet in order to qualify for a home occupation. If these <br />conditions are not met, the Planning Commission may, if they feel it is in <br />the best interest of the City, make the necessary findings to approve the <br />application. <br />Commissioner Wood sympathized with the applicant, but indicated that in a <br />cul-de-sac, the burden of homeowners to maintain appearance of their proper- <br />ties is greater than average. <br />-5- <br />
