Resolution No. 1584 was entered and adopted denying the rezoning appli- <br />cation as petitioned. <br />Roll Call Vote <br />Resolution: Doherty <br />Seconded: Wood <br />Ayes: Doherty, Shepherd, Wood, Chairman Butler <br />Noes: Jamieson <br />Absent: None <br />Abstain: None <br />Secretary Harris indicated that staff is currently preparing a study for <br />Council which would encompass sweeping changes to uses in the C~commercal <br />districts. Study on these uses could be included. <br />Chairman Butler felt that some alternative for this specific application <br />should be instituted separately. <br />Additionally, Mr. Bardet was advised of Mobil Oil Corporation's right of <br />appeal to the denial of his rezoning application. <br />PUD-77-8, Morrison Homes Corporation <br />Review of a negative declaration for a project to develop 39 duplex <br />structures on a 10-acre site located between Hopyard Road and Valley <br />Avenue. <br />Secretary Harris explained the development plan and provided the Commis- <br />sioners with the background surrounding this application. He briefly <br />explained the improvements which would be tied in with Heatherlark Park. <br />Deputy City Attorney Levine explained Condition #2 of the staff report, <br />which would phase the development so that none of the units are occupied <br />during calendar year 1977 and no more than 44 of the 78 units are occupied <br />during the 1978 calendar year was a mitigation measure for potential <br />environmental concerns, including impact on facilities. <br />The Public Hearing was opened on the negative declaration. <br />Mr. Dudley Frost was present to answer questions.
