Study on these uses could be included. Chairman Butler felt that some alternative for this specific application should be instituted separately. Additionally, Mr. Bardet was advised of Mobil Oil Corporation's right of appeal to the denial of his rezoning application. PUD-77-8, Morrison Homes Corporation Review of a negative declaration for a project to develop 39 duplex structures on a 10-acre site located between Hopyard Road and Valley Avenue. Secretary Harris explained the development plan and provided the Commis- sioners with the background surrounding this application. He briefly explained the improvements which would be tied in with Heatherlark Park. Deputy City Attorney Levine explained Condition #2 of the staff report, which would phase the development so that none of the units are occupied during calendar year 1977 and no more than 44 of the 78 units are occupied during the 1978 calendar year was a mitigation measure for potential environmental concerns, including impact on facilities. The Public Hearing was opened on the negative declaration. Mr. Dudley Frost was present to answer questions. He accepted the conditions in the staff report. The Public Hearing was closed on the negative declaration. Resolution No. 1585 was entered and adopted making the finding that a negative declaration be filed with the addition of Condition No. 2 of the staff report as a mitigating condition.
