i <br />Commissioner Shepherd shared Commissioner Wood's concerns on traffic, <br />especially if the contemplated facility is similar to a mini-mart. <br />Deputy City Attorney stated that the question to be answered at this time <br />is whether an ordinance change would have a significant environmental <br />effect. <br />Resolution P1o. 1583 was entered and adopted making the finding that the <br />proposal would have no significant adverse environmental effect and a <br />negative declaration will be filed. <br />Roll Call Vote <br />Resolution: Shepherd <br />Seconded: Jamieson <br />Ayes: Doherty, Jamieson, <br />Noes: Wood <br />Absent: None <br />Abstain: None <br />Shepherd, Chairman Butler <br />Application to rezone a 0.61 acre site located at 5311 Hopyard Road from <br />the C-F (Freeway Commercial) District to the C-S (Commercial Service) <br />District, or to amend Section 2-7.08 (a) of the Code to conditionally <br />allow "service stations including truck and trailer rental and general <br />merchandise sales" in the C-F District. <br />The Public Hearing was opened on the rezoning review. <br />The Commissioners ascertained from staff that general merchandise sales <br />were conditional use procedure in the C-S District. <br />Mr. Bardet of Mobil Oil Corporation indicated that if they need to apply <br />for a conditional use permit, should the ordinance amendment be accepted, <br />he would be willing to exactly pinpoint what items would be sold in the <br />service station. <br />The concept is to change the station to a full self-serve station, which <br />would allow for lower gas prices. To make up for reduced gas revenue, they <br />are proposing the snack facility. The sales room will be 170. sq. ft. <br />Merchandise will be displayed on only one wall. Items to be sold are <br />"impulse" products, including cigarettes, soft drinks, beer, wine, candy, <br />chips, juice, milk, packaged sandwiches. A beer and wine license would <br />need to be secured from the Alcoholic Beverage Control Board. <br />The Public Hearing was closed. <br />Commissioner Shepherd expressed concern regarding sale of wine and beer. <br />He did not object to sale of prepackaged snack foods. But this should <br />specifically be limited so as to not give the impression of being allowed <br />to grow to a miniature 7-11 type of facility. <br />Commissioner Wood wished to recommend denial of the rezoning application <br />for Mobil Oil and the ordinance recommendation be brought back before <br />the Commission for further study. <br />Mr. Bardet emphasized that his application was for a zone change because <br />he was told that would be the only way he could obtain the snack center.. <br />Now, staff is recommending a zoning ordinance amendment. He had no pre.- <br />ference either way, as long as Mobil Oil could establish tFie snack shop. <br />-6- <br />
