A resolution was entered by Commissioner Wood approving the application <br />subject to the conditions in the staff report. Mr. Naggar again stated that <br />requirement of a landscape agreement would be detrimental to the overall <br />plans for development of the project. Commissioner Shepherd. ascertained <br />from Mr. Naggar that each party owns its own site and the developer is <br />agent for all occupants of the center. The Commissioners felt they could <br />go along with deletion of the condition just so long as control is being <br />exercised. <br />Resolution 1602 was entered and adopted approving the application of Taubman <br />Company for design review of the regional shopping center filed under Z-77-187, <br />deleting Condition No. 10, but subject to all other conditions in the staff <br />report of December 14, 1977. <br />Roll Call Vote <br />Resolution: Wood <br />Seconded: Jamieson <br />Ayes: Jamieson, Shepherd, <br />Noes: None <br />Absent: Doherty <br />Abstain: None <br />Wood, Chairman Butler <br />RZ-77-18, Planning Commission - Application to amend Article 8, Chapter 2, <br />Title II of the Ordinance Code of the City of Pleasanton regarding sales <br />in service stations. <br />Secretary Harris presented a draft ordinance recommending wording which <br />would conditionally allow sale of food products, excluding alcoholic beverages, <br />in the C-S and C-F Districts. <br />The Public Hearing was opened. <br />Mr. Tom Bardet of r2obil Oil indicated he was in agreement with the staff <br />report. Next, Mr. Frank Narcisso, East Bay representative for Mobil Oil, <br />explained why their organization felt they should be permitted to maintain <br />the snack center. He indicated that they have four such shops in the Bay <br />Area and have experienced no problems with the beer sales. <br />Commissioner Wood did not agree with the ordinance as proposed. He felt the <br />traffic in that area is severe. The other Commissioners, while not feeling <br />as strongly against the proposal as Commissioner Wood, were lukewarm toward <br />the idea, expressing concern about escalation of the use. Commissioner <br />Shepherd still indicated disapproval of alcoholic beverage sales. <br />The Public Hearing was closed. <br />Commissioner Wood felt a continuance was in order to allow time for further <br />study. Commissioner Shepherd concurred. <br />Chairman Butler felt the sale of alcoholic beverage is not a real concern <br />because this commodity can be purchased anywhere. He was concerned that <br />the ordinance, as proposed, would not control the use from expanding to a <br />7-11 type of store. <br />-7- <br /> <br />
