As an alternate, staff suggested that if the Commission intends to <br />recommend approval of the General Plan amendment, that this matter be <br />continued in order to allow staff an opportunity to negotiate with the <br />applicant for some exchange of land, possibly the rear portion of the park <br />property for the front portion of Mr. McManus ''s property. <br />Secretary Harris then advised the Commission that if the General Plan <br />amendment is enacted, the findings of overriding effect will need to be <br />made. <br />The Public Hearing was opened on the environmental impact report. <br />Mr. McManus was present, as was his attorney, Mr. Peter Turner, who spoke <br />for the application. <br />He commented on the adverse significant environmental impacts listed on <br />Page 40 of the report. He refuted comments made on seismic hazards and <br />possible flooding of the property. He stated that agricultural use of the <br />land is unprofitable, that short term dust generation can be adequately <br />handled. Mr. McManus would be dedicating a 50 ft. strip of land for <br />improvement of Hopyard Road. Regarding loss of park lands, he indicated <br />he would discuss that matter further on in the meeting, and regarding <br />significant reduction of sewer capacity, he stated that homes will continue <br />to be built and it would depend on who obtains the hookups. He did not <br />feel that this is a significant impact. <br />There being no further discussion, the Public Hearing was closed on the <br />review of the environmental impact report. <br />Resolution 1595 was entered and adopted making the following findings for <br />the EIR - 1) they certified that the EIR has been completed in compliance <br />with CEQA and State guidelines 2) they certified review and consideration <br />of the information contained in the EIR and 3) they found that the project <br />would have a significant impact as noted on Page 40 of the EIR, "Significant <br />Adverse Environmental Impacts" and that the area affected would be the <br />City of Pleasanton. <br />Roll Call Vote <br />Resolution: Shepherd <br />Seconded: Wood <br />Ayes: Shepherd, Wood, Chairman Butler <br />Noes: Jamieson <br />Absent: Doherty <br />Abstain: None <br />Commissioner Jamieson disagreed that the items on Page 40 of the EIR would <br />have significant effect on the environment, whereupon Deputy City Attorney <br />Levine clarified that finding significant environmental impacts does not <br />mean a project cannot go ahead, but that these impacts need to be iden- <br />tified. <br />-2- <br />
