GP-78-3, John Amaral - application for a general plan amendment from High
Density Residential to Commercial and Offices for the property located
at 4'04 St. Marys Street (southwest corner of the intersection of St. Marys
Street and Peters Avenue).
Secretary Harris described the staff report recommending denial of the
subject application. He stated the staff has received six letters in
support of the application and two phone calls from St. Marys Street resi-
dents opposed to the application.
The Public Hearing was opened.
Jack Bras, architect, spoke representing the applicant, John Amaral. He
requested Peters Street not be an immovable zoning line, the dwelling on
the subject property is in disrepair, and no land is available in the down-
town area for this proposed use. He added he would like a continuation
for study and review of what is happening in the downtown area, i.e., an
inventory of land available. If this is spot zoning, perhaps all of Peters
Street should be considered for rezoning. He stated further that down-
town parcels under individual ownership cannot compete with professional
ownership.
Harry Spiliotopoulos, who owns property behind 404 St. Marys Street spoke
in favor of the application.
Merton Murray, 210 East Angela Street, stated his mother owns property next
door on St. Marys Street, and he recommends rezoning of entire Peters Street.
Alice Moore, 431 St. Marys Street, spoke in opposition as she was not in
favor of spot zoning because people will start selling out and taxes will
increase.
William Kovac, 7124 Weymouth Court, spoke in opposition to general plan
amendment and spot zoning.
The Public Hearing was closed.
Resolution No. 1667 was entered and adopted recommending denial of GP-78-3.
Roll Call Vote
Resolution: Geppert
Seconded: Doherty
Ayes: Geppert, Doherty
Noes: Wilson
Absent: Getty, Jamieson
Abstain: None
RZ-78-9, Planning Commission - initiation of a rezoning and application
to rezone the approximately 2-1/3 acre site located on the west side of
Foothill Road from the HPD (Hillside Planned Development) District to the
R-1-40,000 District.
Secretary Harris described the staff report recommending rezoning.
-6 -
