Commissioners then asked the audience if there was anyone present for <br />or against Ms. Miller's application to have chickens at her residence. <br />Nancy Lynn a resident of Cristobal Way, stated both she and her son have <br />allergies which are inflamed by chickens. She further stated the odor <br />of the chickens is very bad. She maintains that while the coop is in <br />the applicant's backyard, it is practically in someone else's backyard <br />because of the proximity of property lines. She believes these chickens <br />are very detrimental to the health and welfare of both she and her son. <br />Commissioner Geppert asked Ms. Lynn if the asthma condition described by <br />her has increased since the chickens have been present in the applicant's <br />yard? Ms. Lynn stated she had been off work three weeks this summer but <br />could not prove that. this was as a result of the chickens. Commissioner <br />Geppert asked her if she had a report from the doctor stating that she <br />suffered as a result of the chickens. Ms. Lynn stated that no, she did <br />not, but turkey feathers are an item to which she is allergic. <br />Lorraine Hansen, 4149 Cristobal approached the commission stating she <br />objected to a permit being issued for Ms..Miller's chickens. She stated <br />that the rooster crows regularly and wakes her up at 3:00, 4:00 or 5:00 A.M. <br />and she cannot get back to sleep. She also stated that the smell is <br />very bad. <br />Sally Brollier, 4137 Cristobal Way asked what period of time the permit <br />would cover? Mr. Doherty stated that the permit could be recalled anytime <br />there was a violation against it. Ms. Brollier stated she is opposed to <br />the issuance of this permit and further that the chickens even cackle <br />when they lay eggs. <br />Commission pointed out to the audience that a permit would be issued for <br />four chickens and for six months. <br />'The Public Hearing was closed. <br />Resolution No. 1682 was adopted subject to the conditions shown on the <br />staff report and the stipulation it be issued for a six month period. <br />Roll Call Vote <br />Resolution: Doherty <br />Seconded: Wilson <br />Ayes: Wilson and Acting Chairman Doherty <br />Noes: Geppert <br />Absent: Getty and Chairman Jamieson <br />Abstain: None <br />At the request of Mr. Ruckteschler the agenda was changed whereby the <br />next case would be, UP-78-20 instead of RZ-77-12. <br />UP-78-20, Lance Ruckteschler <br />Application of R. Lance Ruckteschler for a conditional use permit to <br />operate a vehicle storage yard behind the garbage transfer station located <br />at 31.10 Busch Road. The site is zoned I-G (General Industrial) District.. <br />Negative declaration of environmental impact is also considered. <br />-6- <br />
