Tentative Map, Tract 3458 Falender Corporation <br />Application for Tentative Map, Tract 3458 to subdivide the approximately <br />12-acre parcel of land located immediately east of Foothill High School <br />between Lemonwood Way and Alder Court into 36 separate parcels. Zoning <br />for the property is PUD (Medium Density Residential) District. <br />Mr. Harris explained the staff report and the fact that the applicant is <br />conforming with the zoning except for the manner of construction. <br />Mr. Harris suggested approval as per PUD and details worked out with <br />staff later on. Commissioner Leppert asked the average lot size and <br />Bob Harris responded 6200/6500 square feet, a zero lot line PUD. <br />Commissioner Wilson addressed the RAP program with regard to Falender <br />when they return as there is a lot of area he isn't developing. He asked <br />if they were still required to put in a 12" water main. Mr. Harris <br />responded yes. Mr. Wilson inquired as to whether or not Falender has used <br />up all of his points and asked when he comes back what is your (Bob) <br />recommendation going to be to RAP -- you can't get points for water <br />loop it appears when he comes in the next time -- Mr. Harris responded this <br />is a weakness in the RAP program. Staff will be working on this over <br />the next year. <br />Commissioner Wilson addressed item #14, street lights and asked whether <br />this requirement was made prior to Proposition #13 or after. Mr. Harris <br />stated he didn't know what engineering will require or how many they will <br />now require. Commissioner Wilson addressed condition #17, Park Dedication <br />and do we know whether or not Falender has satisfied the park dedication <br />fees. Mr. Harris explained that the reason it is not stated with more <br />finality is that it takes time to investigate this type of thing in <br />the records. We don't always do this prior to submittal to the Planning <br />Commission. It will be equitably worked out no matter what the situation <br />is. <br />Chairman Jamieson stated item #6 is nebulous and the Planning Commission <br />is concerned. Mr. Harris explained detailed improvement plans will <br />have to be drawn and submitted. Chairman Jamieson addressed item #14. <br />He asked if Falender was allowed to apply for sewer permits. Mr. Harris <br />stated he could apply but probably will have to wait until the next <br />allocation. <br />The public hearing was opened. <br />Fred Falender, the applicant spoke, stating he has a copy of the trans- <br />cript of the minutes of April 10, 1978 and item #10 as shown in the <br />ordinance does not match the transcript. Bob Harris stated that this <br />item, as written, is contradictory. He stated he recommends approval <br />subject to the conditions of PUD-78-2, Ordinance No. 851. Mr. Falender <br />asked for item 16 to be clarified -- street improvement damage. <br />Mr. Harris explained. Commissioner Wilson addressed item 14 and would <br />like to know what the City is asking the developers to do with this <br />regard. Mr. Harris stated he doesn't know. Commissioner Doherty <br />addressed Council Member Brandes about the City's position with regard <br />to lighting. Mr. Brandes elaborated. Larry Bardelson then spoke to <br />the design of lights by PG&E with city staff approval. Preliminary plans <br />are completed and submitted to PG&E. He assumes the requirement is <br />pre-Proposition 13. Chairman Jamieson stated that we are obliged to <br />-7- <br /> <br />
