The public hearing was then opened. <br />Bill Hirst, attorney for the applicant (147 Bernal) spoke stating he had <br />reviewed the staff report with Larry Billings and Tom Richert. He <br />stated it is true some of the materials in the December 19 letter aren't <br />"Garden Center." He re-emphasized it would be basically the same operation; <br />high quality redwood lumber, etc. <br />He stated the site is appropriate for the uses proposed. He stated what <br />is really being talked about is how to go about affecting the proposal. <br />He stated the 12/19/78 letter is subordinate to providing finished lumber -- <br />the use permit is already granted. He urged the Planning Commission to <br />make a determination that continuing operation is compatible with the <br />definition of "Garden Center" and allow the applicants to proceed. He <br />stated Mr. Richert is aware that by extending the product line he is staring <br />rezoning in the face. He stated he and Casa Verde would be more than <br />willing to work with the Planning Commission, Staff and City Council to <br />effect reasonable land use to put the site; C-S, L-I, I-P or whatever it <br />might be. He urged again the Planning Commission to allow these appli- <br />cants to proceed. He stated a C-S zoning would require a General Plan <br />Amendment and this could take several months and rapid action is necessary. <br />A minor modification of the use permit as indicated by Staff and then the <br />applicants would be more than happy to work with the City in any way to <br />effect a permanent land use designation change. <br />The public hearing was closed. <br />Commissioner Doherty made a motion which was seconded by Commissioner <br />Geppert to accept the request made in the December 19, 1978 letter as <br />substantially conforming to things that can be sold in the Garden Center, <br />as shown in Ordinance No. 823. <br />Resolution No. 1710 was then adopted making the findings that the uses <br />requested are substantially in conformance with the items and the intent of <br />Ordinance No. 823. <br />Roll Call Vote <br />Motion: Commissioner Doherty <br />Seconded: Commissioner Geppert <br />Ayes: Commissioner Doherty, Geppert, <br />Noes: None <br />Absent: None <br />Abstain: None <br />Getty, Wilson and Chairman Jamieson <br />Commissioner Wilson then pointed out that perhaps approval is being given <br />to something the applicant feels he is allowed to interpret. <br />A motion was made by Commissioner Doherty and seconded by Commissioner <br />Getty that the staff get together with the applicant to look at the land <br />use.
