After the vote, Pat Jennings, 932 Longview Drive, addressed the Com- <br />mission stating she had not signed the petition of McGovern addressed <br />earlier. She stated her house has problems with cracks in the walls, <br />and driveway and that if this project goes through it would cause her more <br />problems because it is up above her property. She wanted to know who <br />would accept the liability for her property becoming damaged. She stated <br />Dr. Long handed her a 1968 report thinking it would answer all of her <br />questions, but it didn't and that as far as she knew the grading done <br />previously wasn't done with a permit. She felt the potential for fire <br />hazards would be greatly increased with this added project in that all of <br />the property is surrounded by dry brush and that her family is extremely <br />careful during the dry months and, also, new houses with fireplaces <br />would add to this risk. She stated fire hydrants would have to be <br />added and there would have to be access to the hydrants from the back <br />as well as the front. She stated this project would chase off the <br />wildlife (deer, raccoons, rabbits, etc.). She stated 10 houses of the <br />nature described would have dogs, cats, children causing significant <br />noise impacts. She spoke to the co-ownership of the common area. She <br />said a swimming pool would also have large noise impacts. She stated <br />children have to walk down Longview to get to school and this would be <br />very dangerous with 20 plus cars and their safety would be jeopardized. <br />She stated she wouldn't have bought the house if she knew there would be <br />development. Commissioner Wilson asked Mrs. Jennings if she would <br />object to the City Building Department coming to her house and reviewing <br />the damage she earlier described. Mrs. Jennings responded that she had <br />no objections to this. Chairman Jamieson inquired whether or not there <br />was a soils survey done on Jennings property? Mrs. Jennings responded <br />she assumed the previous owner has it. <br />Dr. Long, 363 St. Marys Street, spoke addressing Commissioner Doherty's <br />concern with a fire truck being able to ascend Longview. He stated <br />he saw it done in 1963. Dr. Long stated apparently the contractor did <br />not properly excavate the Jennings house and heard Mr. Hart state the <br />workers dumped dirt in holes where concrete should have been. Dr. Long <br />addressed grading being done without a permit. He stated he thought the <br />contractor had taken out proper permits for this grading. <br />This project was then continued to March 7, 1979, 7:30 Alameda County <br />Fairgrounds. <br />UP-79-O1, Alberta Barrious <br />Application for a conditional use permit to allow the operation of a <br />nursery school with a maximum of 12 children at the single family resi- <br />dence located at 932 Riesling Drive. Zoning for the property is <br />R-1-6500 District. <br />Mr. Harris explained the staff report stating that Mrs. Barrious has done <br />babysitting in her home for some time and that she wasn't aware she <br />needed to be licensed by the City. He stated that "Nursery School" as <br />used by the City is not the proper terminology for what Mrs. Barrious <br />wants to do. He stated she is really a babysitting service in the <br />truest sense of the word. He stated the staff recommends approval of <br />this application with a trial period of one year with review at that time <br />by the staff with no additional charge to the applicant.
