Parcel Map Exemption, -.. R. Grace Development Com~.__ny <br />Request of W. R. Grace Development Co. and Burger King for an exemption <br />from filing a parcel map for leasing a portion of the 1.7 acre parcel <br />located on the west side of Hopyard Road approximately 700 ft. south of <br />I-580 to Burger King Corporation. <br />Mr. Harris explained the request for this exemption and stated the only <br />purpose which would be served in filing a parcel map would be to satisfy <br />the Map Act since the property is owned by one person. <br />Commissioner Wilson asked why the filing of a parcel map was requested <br />in the first place? Mr. Harris explained the Map Act requires it but <br />under special circumstances such as this project, it could be waived if <br />certain findings were met. <br />Harvey Levine, City Attorney, confirmed to the Planning Commission that <br />this is law and agreed with Mr. Harris that a parcel map, in this instance, <br />was meaningless. <br />Mr. Brad Hirst, representing the applicant spoke stating to file a parcel <br />map would take time and money and is not necessary when the land is <br />owned by one person. He urged the Commission to grant this exemption. <br />Resolution No. 1725 was then entered and adopted exempting W. R. Grace <br />Development Company from the requirement that they file a parcel map prior <br />to leasing a portion of the 1.7 acre parcel located on the west side of <br />Hopyard Road approximately 700 ft. south of I-580 to Burger King Corpor- <br />ation. This exemption was granted under the provision of Section 2-3.09, <br />Chapter 1, Title II of the Ordinance Code of the City of Pleasanton after <br />all of the findings were made. <br />Roll Call Vote <br />Motion: <br />Seconded: <br />Ayes: <br />Noes: <br />Absent: <br />Abstain: <br />Commissioner Geppert <br />Commissioner Getty <br />Commissioners Doherty, <br />Chairman Jamieson <br />None <br />None <br />None <br />Geppert, Getty, Wilson and <br />RZ-77-19, City Council <br />Report regarding Council changes to Planning Commission recommendation on <br />case RZ-77-19, an application to amend Section 2-7.08(a), Chapter 2, <br />Title II of the Ordinance Code of the City of Pleasanton which would <br />revise comprehensively the schedule of permitted and conditionally per- <br />mitted uses in the C-R, C-C, C-S, C-F and C-A Districts. <br />Mr. Harris spoke stating that the staff has no problem with the changes <br />made by the City Council concerning the uses. He stated it is the staff's <br />opinion the changes are appropriate. <br />Commissioner Getty asked for an explanation of a "Neighborhood Shopping <br />Center." Mr. Harris explained. Commissioner Jamieson asked about "Massage" <br />and Mr. Harris stated this is still regulated by City Ordinance. Commis- <br />sioner Getty stated she was upset with what is allowed in a "Neighborhood <br />Shopping Center." Mayor Brandes stated that Commissioner Getty's concerns <br />-12- <br />
