Planning Commission <br />May 9, 1979 <br />Page 4 <br />PUD-79-2, Joe Boatright and Ray Goodrich <br />Application of Joe Boatright and Ray Goodrich for rezoning to PUD (Planned Unit <br />Development) District and development plan approval for an 11-lot residential subdivision <br />on 55 acres of the 73 acre site located west of Foothill Road and north of Longview <br />Drive. The Planning Commission may recommend rezoning the 73 acres as requested or <br />recommend any other zoning consistent with the General Plan. <br />Mr. Harris explained the staff report. He stated that further staff work needs to <br />be done on this project because it is an involved case and that the staff is asking <br />the Planning Commission tonight to consider only the environmental assessment and <br />whether the project conforms to the General Plan. He stated that in the staff's <br />opinion the development is both non-urbanization and open space and gave reasons for <br />this opinion. He then stated staff feels a mitigated negative declaration is appropriate <br />in that a geological report has been prepared based on the development plan and <br />addresses the proposed building sites thoroughly. He also referred to tentative <br />conditions attached to the staff report (from Longview PUD). <br />Commissioner Wilson addressed the Initial Study (Item ~~1) and had concerns with how <br />the Commission could take action on a negative declaration with no definition of <br />"urban". He stated to him an 11-unit subdivision is urbanization. In response to <br />Commissioner Geppert, Mayor Brandes said it would not be appropriate at this time for <br />him to say what the City Council's policy would be regarding this issue and that <br />Council would be looking for Planning Commission input in this matter. <br />The public hearing was opened. <br />Bill Hirst, 147 Bernal Avenue, attorney for the applicant spoke. He stated they <br />have been working with the City staff for several months on this project. He referred <br />to a memorandum of July 14, 1978 from the Director of Planning referring to a <br />geological report and that a soils and geological report were provided answering <br />concerns of this memorandum. He also referred to the text of the General Plan, Page 25, <br />dealing with the Conservation and Open Space Element. He stated this property has <br />been in the water and sewer districts established in 1967 and that the applicant <br />concurs with the staff report. He stated nothing in the General Plan states the <br />definition of urbanization. He referred to City-County correspondence suggesting <br />one dwelling unit per five acres being considered non-urbanization. He stated an <br />EIR should not be required because of the extensive environmental work done for the <br />Longview project. <br />Judd Hull, 1441 Greenwood Drive, Geo-Technical Consultant for the project, spoke <br />addressing the geological/soils report which he helped prepare. He explained the <br />report. <br />Bruce Sasak, 9188 Longview Drive, spoke representing neighboring homeowners. He <br />stated they are not in agreement with staff concerning urbanization and that in their <br />opinion 11 clustered homes does constitute urbanization and while not mentioned, <br />Lot ~F12 is proposed for R-20,000 which he believes is urbanization. He said this <br />development is precedent setting, does have adverse environmental impacts and would <br />put a strain on current utilities, is opposed to any septic tanks and no bedrock was <br />found. He also addressed concerns with fire, increased traffic and loss of open space. <br />Ron Archer spoke addressing urbanization and the fact that it doesn't include the <br />entire piece of property. He stated Judd Hull's report states that the property is <br />stable enough for development and that they are working with Staff concerning the <br />cul-de-sac.
