PLANNING COMMISSION MINUTES JULY 26, 1979 (continued) <br />Getty that Resolution No. 1769 approving UP-79-15, application of Joe Madden for a <br />conditional use permit to allow the warehousing and wholesaling of food products in <br />the commercial service complex presently under construction at 3701-23 Old Santa <br />Rita Road subject to the four conditions of the staff report; plus a fifth condition <br />which limits the amount of space which may be allocated for this use; Kilpatrick's <br />Bakeries, Inc., Units 413 and 414, 2000 sq. ft.; R & G Distributors, Unit ~~22, 1,000 <br />sq. ft.; and School Sales Company, Unit X65, 800 sq ft. be adopted. <br />ROLL CALL VOTE <br />AYES: Commissioners Getty, Wilson and Chairman Doherty <br />NOES: Commissioners Geppert and Jamieson <br />ABSENT: None <br />Mr. Pearson asked how long he had to appeal this decision. Staff advised that an <br />appeal must be filed within 15 days. <br />PUD-79-5, Michele Myers <br />Application to rezone a 9.1 acre site located east of Santa Rita Road approximately <br />120 ft. north of Mohr Avenue from the P (Public and Institutional) District to <br />the PUD (Planned Unit Development-Commercial and Offices) District and to designate <br />appropriate commercial uses by area within that site. A negative declaration of <br />environmental impacts will also be considered. <br />Mr. Harris presented his report dated July 26, 1979 regarding this matter. <br />Commissioner Getty expressed concern regarding getting too much office space in the <br />City and asked staff how much was available at this time. Mr. Harris replied he did <br />not have this figure available. Commissioner Jamieson stated he felt it would be <br />difficult to make a decision without knowing how much is designated for office. <br />Commissioner Wilson stated that until such time as interest rates were reduced he <br />did not think there would be an abundance of office buildings being constructed. <br />Chairman Doherty declared the public hearing open on the application and negative <br />declaration. <br />Michele Myers, 1811 Santa Rita Road, applicant, stated she wanted to keep retail priorities <br />in Pleasanton, however, she felt staff's recommendation of 5 acres zoned for office <br />was excessive and requested that this be changed to 4.5 acres zoned office and 3.6 <br />acres zoned C-C. <br />No one spoke in opposition to this item. <br />There being no further testimony, Chairman Doherty declared the public hearing closed <br />on the application and the negative declaration. <br />It was moved by Commissioner Jamieson and seconded by Commissioner Geppert that <br />Resolution No. 1770 approving the negative declaration. <br />ROLL CALL VOTE <br />AYES: Commissioners Geppert, Getty, Jamieson, Wilson and <br />Chairman Doherty <br />NOES: None <br />ABSENT: None <br />It was moved by Commissioner Geppert and seconded by Commissioner Getty that <br />Resolution No. 1771 recommending approval of PUD-79-5, application of Michele Myers <br />to rezone a 9.1 acre site located east of Santa Rita Road approximately 120 feet <br />-11- <br />
