He stated that although properties contribute to the two <br />assessment districts they are not within the Urbanization Line while people who contribute <br />nothing are within the boundaries. He stated the line was probably made with the 1972 <br />Settlement Agreement in mind and this doesn't make sense. Mr. Wilson addressed Mr. <br />Pearson's concern regarding the 55 million dollar suit by developers against the City <br />and stated it was a result of a person at VCSD who could not count in the early 1970's. <br />Commissioner Wilson then asked Mr. Pearson if the Urbanization Line makes sense to him. <br />Pearson responded that if you follow it, you could keep your neck out of the wringer <br />avoiding another lawsuit. <br />Bill Gibson, Mickey DeFreitas, 1963 Foxwallow,and Gene Finch, 582 Sycamore spoke <br />in favor of this project. <br />Bill Hirst rebutted the statements made of the earlier speakers and addressed 'arbitrary' <br />used in connection with the project. He again reiterated the property has participated <br />in assessments of two districts for years and is entitled to develop. He stated all of <br />the proper soils reports, etc. have been made and he urged approval of the project. <br />Mr. McGovern and Mr. Pearson again spoke urging denial. <br />The public hearing was closed. <br />Commissioner Getty asked when the Urbanization Line was established and Mr. Harris <br />responded. Commissioner Jamieson then stated that septic tanks vs sewers would have to <br />be considered by the City Council. Mr. Harris stated that a condition of the staff <br />report is that the development would be required to hook up to sewers. Commissioner <br />Geppert addressed the probable error in the City Council Minutes of June 26, 1979 <br />concerning the number of units per acre. Mr. Harris concurred that this was probably an <br />error. Mr. Harris then explained the number of sewers now available to this development <br />and the likelihood that this project may get more. He further stated that perhaps when <br />the Urbanization Line was drawn, the City Limit should have been used. <br />Commissioner Jamieson then inquired as to whether or not the County Geologist reviewed <br />the soils report. He asked the Commissioners how they felt about having the County <br />Geologist review the report. Chairman Doherty stated this wouldn't be necessary unless <br />required by law. He stated he didn't know whether anything would be gained by it. <br />Mr. Harris stated that when development plans are submitted we could require the County <br />Geologist to review them. Mr. Harris stated the staff is satisfied with a Mitigated <br />Negative Declaration as proposed as the approval of the project would have many conditions <br />which would mitigate any significant adverse effects. <br />Chairman Doherty stated that the City has a lot of control over a HPD development. A <br />motion was made by Commissioner Getty, seconded by Chairman Doherty that there are <br />significant impacts involved in this project which could be mitigated by the conditions <br />of approval to insigificant levels and that the Mitigated Negative Declaration be <br />approved for PUD-79-2. <br />ROLL CALL VOTE <br />Ayes: <br />Noes: <br />Commissioners Getty, Jamieson, Wilson and Chairman <br />Doherty <br />Commissioner Geppert <br />Resolution No. 1780 was then entered and adopted approving the Mitigated Negative <br />Declaration for PUD-79-2. <br />
