Resolution No. 1794 was then entered and adopted denying RZ-79-13 as <br />petitioned. <br />The applicant was then advised of his right of appeal to the City <br />Council within 15 days. <br />UP-79-14, McDonald's Corporation <br />Application for a conditional use permit to allow the construction and <br />operation of a McDonald's restaurant with a drive-through facility on <br />the parcel located at the northeast corner of the intersection of Pimlico <br />Drive and Santa Rita Road. Zoning for the property is C-F (Freeway <br />Commercial) District. <br />This case was continued to October 10, 1979. <br />NEW BUSINESS - Public Hearings <br />RZ-79-16, John Caroline <br />Application of John Caroline to rezone a 5 acre site on the north side <br />of Happy Valley Road between the WPRR and I-680 from the I-P (Industrial <br />Park) District to the O (Office) District. The Planning Commission may <br />recommend approval of the proposed change or may recommend rezoning the <br />property to any other zoning district consistent with the General Plan. <br />Mr. Harris explained the staff report and stated the rezoning is proper <br />in that it conforms with the General Plan as recently approved. <br />The public hearing was opened. <br />John Caroline, 4487 Pleasanton Avenue, the applicant spoke. He stated <br />he had no questions concerning the staff report and would be happy to <br />answer any questions the Commission might have. <br />There were no questions and the public hearing was closed. <br />A motion was then made by Commissioner Leppert, seconded by Commissioner <br />Getty that RZ-79-16 be recommended for approval as per the staff report. <br />ROLL CALL VOTE <br />Ayes: Commissioners Getty, Geppert and Chairman Doherty <br />Noes: Commissioner Jamieson <br />Absent: Commissioner Wilson <br />Resolution No. 1795 was then entered and adopted recommending RZ-79-16 <br />be approved. <br />RZ-79-18, Castlewood Enterprises <br />Application of Castlewood Enterprises to rezone a 9.84+ acre site located <br />on the east side of Foothill Road approximately 550 feet south of Bernal <br />Avenue from the R-1-6500 (Single-Family Residential) District (6,500 sq. <br />ft. minimum lot size) to the R-1-20,000 (Single-Family Residential) <br />District (20,000 sq. ft. minimum lot size). The Planning Commission <br />may recommend approval of the proposed change or may recommend rezoning <br />the property to any other zoning district consistent with the General <br />Plan. A negative declaration of environmental impacts will also be <br />considered. <br />-4- <br />
