Commissioner Jamieson indicated he would prefer to change/delete the
date on the variance to spot-rezoning of this property.
Commissioner Leppert agan stated he didn't feel this area is appro-
priate for residential zoning. He stated the General Plan is wrong
as far as he is concerned.
Mr. Harris reminded the Commission that the area is presently zoned
Residential and the street has residential uses on it. A rezoning would
create mixed land uses.
Commissioner Jamieson stated he would like to know when Jorgensen
plans to move and relocate. Tom Jorgensen responded that this is diffi-
cult to tell and is predicated on how well the business does. Jorgensen
further stated he could not expand on the land he purchased in 1950
and if forced to move because they cannot expand and sold the land it
would restrict the land use as they would have to move the warehouse
building, etc. He stated the area is not a prime R-1 area.
Commissioner Jamieson stated if the property was rezoned to C-S and
Jorgensens move out, they could sell the property for more money.
Commissioner Getty stated she shared the same feelings. She stated the
Jorgensens have a low-profile business but feels that if they are at
their limits they would probably move in the near future and control
would be lost.
Commissioner Jamieson then asked how close the nursery school was to
the subject site and Mr. Harris explained the proximity.
Commissioner Doherty stated he is opposed to "spot zoning" and the
neighbors have expressed opposition to commercial in this area and he
could not support rezoning of this property.
A motion was made by Commissioner Geppert, seconded by Commissioner
Jamieson that the proposed project would not have a significant
effect on the environment and, thus, recommended the negative declara-
tion be approved.
ROLL CALL VOTE
Ayes: Commissioners Geppert, Getty, Jamieson and Chairman Doherty
Noes: None
Absent: Commissioner Wilson
Resolution No. 1793 was then entered and adopted approving the negative
declaration for RZ-79-13.
A motion was then made by Commissioner Jamieson, seconded by Commissioner
Getty that RZ-79-13 be denied.
ROLL CALL VOTE
Ayes: Commissioners Getty, Jamieson and Chairman Doherty
Noes: Commissioner Geppert
Absent: Commissioner Wilson
-3-
