ROLL CALL VOTE <br />Ayes: Commissioners Geppert, Getty, Jamieson, Wilson and <br />Chairperson Doherty <br />Noes: None <br />Resolution 1823 was then entered and adopted for the negative declaration <br />for case RZ-79-22. <br />A motion was then made by Commissioner Jamieson, seconded by Commissioner <br />Geppert that RZ-79-22 be recommended for approval. <br />ROLL CALL VOTE <br />Ayes: Commissioners Geppert, Getty, Jamieson and Chairperson Doherty <br />Noes: Commissioner Wilson <br />Resolution No. 1824 was then entered and adopted recommending approval <br />of RZ-79-22 as petitioned. <br />PUD-79-12, Henr Cu les <br />Application o Henry Cupples for development plan approval for a restaurant <br />to be located on a 0.9 acre portion of a 6.1 acre site located at the <br />southeast corner of Hopyard Road and I-580. The zoning for the property <br />is PUD (Planned Unit Development) District. A negative declaration <br />of environmental impacts was also considered. <br />Mr. Harris reviewed the staff report. He stated the property is unusual <br />in that there is no access proposed via a road or driveway directly onto <br />the site and that access is obtained through an easement over the Burger <br />King/Grace property. <br />Commissioner Wilson addressed the storm drainage system and whether it was <br />public or private. Walt Schaumburg explained. <br />The public hearing was opened. <br />J. Jack Bras, architect for the project spoke. He stated that basically <br />they concurred with the staff report but did have a couple of questions <br />concerning a couple of the conditions. He addressed the storm drains <br />and flood plain and further discussed the trees with regard to condition <br />#16. <br />Commissioner Jamieson inquired about the sewer drains. He stated it is <br />possible that each piece of property might have laterals to the street <br />without being tied into the trunk line and that the line is private <br />until it gets to the street. <br />Commissioner Getty inquired as to whether or not the structure would be <br />two-stories. Mr. Bras explained there is a change of levels within the <br />structure but that it is not a two-story building. <br />A motion was made by Commissioner Geppert, seconded by Commissioner Getty <br />that the negative declaration prepared for PUD-79-12 be approved as <br />prepared finding that there would be no significant negative impacts <br />on the environment. <br />-8- <br />
