RZ-79-22, Joseph Madden <br />Application of Joseph Madden to rezone the 2.0 acre site located at <br />3851 Vineyard Avenue from the RM-4000 (Multiple Residential, 10 units/ <br />acre) to the RM-1500 (Multiple Residential, 29 units/acre) District. <br />A negative declaration of environmental impacts was also considered. <br />Mr. Harris explained the staff report and the recommendation of denial. <br />The public hearing was opened. <br />Mr. Joseph Madden, the applicant, spoke stating he purchased the property <br />20 years ago and the City rezoned his property in January, 1965. He <br />said he has paid for a sewer line and donated a 1,437 sq. ft. easement <br />across the property. He stated that three years ago the City Council <br />downzoned the property to RM-4000. He further stated that with the <br />current economic constraints it is not possible to develop the property <br />with the current zoning. He further stated that Pleasanton Greens which <br />is next door to his property will have low taxes because it is pre- <br />prosition 13, whereas, his property will be subject to current values <br />if developed. He stated that with his proposed 48 units he would have <br />more than two parking spaces per unit. Mr. Madden took issue with the <br />third paragraph of the staff report where it stated no money has been <br />set aside for construction of Pico to Stanley Boulevard. He stated <br />Mr. Auf der Maur has a two year schedule for his road plans. He further <br />stated he does not believe this proposal is premature as outlined in the <br />staff report. He stated if anything the application for rezoning is <br />late as it takes two years to obtain financing and you must go through <br />the RAP program. He addressed traffic to Vineyard and stated it would be <br />at a minimum. <br />The public hearing was closed. <br />Commissioner Jamieson stated he was on the Planning Commission when the <br />property was downzoned stating he supported Mr. Madden. at that time. <br />He stated developers are constrained as to what they can put up con- <br />cerning low cost housing. He further stated that traffic on Vineyard <br />could support more units. <br />A motion was made by Commissioner Jamieson, seconded by Commissioner <br />Leppert that the negative declaration filed for case RZ-79-22 be approved. <br />ROLL CALL VOTE <br />Ayes: Commissioners Leppert, Getty, Jamieson, Wilson and Chairperson <br />Doherty <br />Noes: None <br />Resolution No. 1823 was then entered and adopted for the negative declaraW <br />tion for case_RZ-~9-22. <br />A motion was made by Commissioner Jamieson, seconded. by Commissioner <br />Leppert that the negative declaration filed for case RZ-79-22 be <br />approved. <br />-7- <br />
