Commiss:.ioner Leppert then took issue where Mr. Jotten spoke to addi- <br />tional police and fire protection. Mr. Jotten then addressed page 48 of <br />the EIR. <br />Mr. Harris stated that Volume II of the EIR speaks to residential use. <br />Mr. Jotten stated he did not agree with that. <br />Robert M. Pearson, 3590 Churchill Court, Pleasanton - Mr. Pearson <br />addressed comment #3, page 6-4 of the EIR concerning sewage require- <br />ments for the project. He stated he did not agree with the figures and <br />took issue with the method by which they were derived. Iie stated that <br />dry weather flow must be used and not the flow at the time the report <br />is made as it is low in the winter and high in the summer because people <br />are watering more and using more facilities during the summer months. <br />He further stated that in comparing a 1975 report which he has in <br />his files to current data it indicates we have had no increases in <br />sewage commitments. He addressed a City commitment to Kaiser and the <br />Fairgrounds against the total proposed capacity. <br />Commission Geppert then asked Mr. Pearson what the usage should be <br />for this project. <br />Mr. Pearson stated that there is a maximum of 120,000 gallons remaining <br />which are not spoken for and that if the City doesn't come out right <br />they are in for more lawsuits like that of 1972. <br />Commissioner Wilson then asked Mr. Pearson what position he took with <br />regard to the LAWVMA pipeline. Mr. Pearson responded that his position <br />was negative on the entire project. <br />John P. Corley, 3744 Trenery Drive, attorney for Utility Vault - <br />Mr. Corley stated they are in favor of the plan as originally proposed <br />for an industrial park. He stated Utility Vault is heavy industry and <br />would not be compatible with a new residential complex. He stated Utility <br />Vault manufactures concrete products for PG&E et al, has 75 employees <br />with two shifts which finish at midnight and the business operates 5 days <br />per week. He stated that by allowing residential into this area Utility <br />Vault would be put in a position whereby it would be just a matter of <br />time before the residents would be complaining about noise and that this <br />has happened in other areas. <br />Commissioner Geppert asked Mr. Corley when representing Utility Vault had <br />he ever participated in discussions with Kaiser concerning El Charro <br />Road. Mr. Corley stated that a railroad track divides them, that they <br />only have about 10-20 trips per day and that they are not a massive <br />user of Valley Avenue or Santa Rita Road, but that there was never any <br />definitive discussions between Utility Vault and Kaiser. <br />Ken Best, 2350 Royal Oaks - He stated he has a business in Union City <br />where homes moved in next to the business and within a short period of <br />time they were complaining about the noise. He stated he is in favor of <br />an industrial park. <br />Larry Osborne, 1159 Kottinger, representing the Industrial Committee of <br />the Chamber of Commerce - He stated his committee unanimously approved the <br />first plan of Caroline's which was submitted.
