Commissioner Leppert stated he was not convinced that a blanket con-
ditional use permit should be issued as he did not wish to destroy
the 'conditional use system'.
Commissioner Jamieson stated he agreed that in granting this use
permit it might be precedent setting.
Mr. Harris stated in instances of this type, it created a big
inconvenience in getting tenants and often tenants moved in and then
were informed they need a conditional use permit and, thus, this
application would be beneficial to all concerned. Mr. Harris
further stated that, yes, this would be precedent setting.
Commissioner Wilson stated that in granting this conditional use
permit it would be helpdul in renting 15-20 areas and it will allow
the developer to rent knowing that he can put a particular type use
on the property. He stated in not allowing the application, each item
would have to be advertised, would require staff work and Planning
Commission time and supports the staff recommendation.
Commissioner Jamieson made a motion that
per the staff report eliminating item 2,
mobile Repairing, Overhauling and Painti
tinning Shops and Household Repair Shops
could be made in granting this approval.
by Commissioner Wilson.
case UP-79-24 be approved
9 and 10 relating to Auto-
ng, Heating and Air Condi-
as all the required findings
This motion was seconded
ROLL CALL VOTE
Ayes: Commissioners Jamieson and Wilson
Noes: Commissioners Geppert, Getty and Chairperson Doherty
Resolution No. 1830 was then entered and adopted denying case UP-79-24.
The applicant was then advised he had 15 days in which to appeal this
decision.
NEW BUPINESS --Public Hearing
UP-79-25, Earl Adams
Application for a conditional use permit to allow the establishment of
an automobile repair service in the commercial service building under
construction at 3687 Old Santa Rita Road. Zoning for the property
is C-S (Commercial Service) District.
Mr. Harris presented the staff report and its recommendation of approval.
Commissioner Geppert then asked how many categories this would cover,
to which Mr. Harris responded, this application is only for one use and
would be a blanket approval for the entire building enabling more
than one auto repair service to be located on the site.
-3-
_._......... _.... _... ... _...._ . .,. .. . .. ._. ....T_. ~. .. .__.. _. ___ _._. _..._ .. _~ __.. . ..._. .. __ .. .- ._. .. ..._ ..~._ __
