Resolution No. 1833 was then entered and adopted recommending approval <br />of the EIR for case PUD-79-13. <br />A motion was then made by Commissioner Getty, seconded by Commissioner <br />Geppert that PUD-79-13 be approved subject to the conditions outlined <br />on page 9 and 10 of the staff report with the following changes: <br />Condition #3: Eliminate: "The soils investigation would be done <br />by a qualified consultant under contract with the <br />City and the cost of the study reimbursed to the City <br />by the developer." <br />Add: That the City reserves the right to verify <br />this study through use of the County geologist or <br />the State Soils and Foundation Engineers Association <br />under contract with the City with the cost of veri- <br />fication to be reimbursed to the City by the <br />developer. <br />Condition #9: Change: "traffic generated" to "truck traffic <br />generated" <br />Add: <br />Condition #12: Increase the landscaping buffer on the west side <br />from 25 ft. to 30 ft. <br />#13: That the minimum distance between any building <br />on the subject property and any residential lot <br />line shall be 75 ft. <br />#14: That the maximum height of any building along the <br />west side of the subject property shall be 14 ft. <br />#15: There be no restaurants or other high traffic <br />generating types of uses established on the west side <br />of the development. <br />#16: That business hours of all of the businesses in the <br />park be 7:30-5:30 P.M. <br />(after discussion it was agreed to eliminate condition <br />#16 to be added at development approval state) <br />#17: That a dust control plan be submitted to the City for <br />approval and that a restriction be put on it to <br />eliminate grading when winds reach 15 mph. <br />#18: That "D" circle come no closer than 200 ft. to <br />the western property line of subject property. <br />P4r. Caroline was asked if he cared to comment on any of the conditions. <br />Mr. Caroline stated he would prefer the hours of 7:00 A.D-i. to 5:00 P.M. <br />and that the 14 ft. height limit be 'aboveground,' possibly allowing <br />a 16 ft. building.
