Commissioner Jamieson asked if this project were approved for xxx <br />amount of lots, wouldn't we have to guarantee sewer capacity for them. <br />Mr. Harris stated he wasn't a lawyer and couldn't comment on that, but <br />that the Planning Commission merely recommends approval of the project <br />and when it is considered by the City Council, they will be counselled <br />by the City Attorney regarding City commitments. <br />Commissioner Geppert addressed assessment districts for this property. <br />Mr. Caroline stated that at the current time they are attempting to <br />get an assessment district for 200 acres of Best property, Utility <br />Vault and Molinaro property through Mr. Brunsell, the City bond attorney, <br />at no cost to the City. He stated the obligation would be backed by <br />the property itself. <br />Commissioner Geppert asked if the City has looked at the cost benefits <br />of this project to the City vs. how much it will cost the City. Mr. <br />Harris responded that no study has been done. He stated that Pro- <br />position 13 and 4 have made industrial less fiscally attractive as <br />industrial growth is no longer recognized as growth. <br />Commissioner Jamieson then addressed exporting materials from the site <br />via E1 Charro. Mr. Caroline stated there will be no export except <br />for the man-dumped material which is being put in a Class 3 dump <br />site nearby. Mr. Caroline stated that Val Vista, Del Prado, Valley <br />Trails development were built on very poor soil and that the 69 acres <br />of business park has much better soil than any of those areas. <br />Commissioner Jamieson stated that concerning the moving activity, <br />there should be some hour restrictions namely 7:30-5:30 P.M. Monday <br />through Friday. <br />Commissioner Geppert then asked Mr. Caroline if he had any problems <br />with the requests of Mr. Jotten. Mr. Caroline said he had no problems <br />with Mr. Jotten's requests. <br />A motion was made by Commissioner Geppert, seconded by Commissioner <br />Getty that: the EIR has been completed in compliance with CEQA and <br />State Guidelines; that the Commission has reviewed and considered the <br />information in the EIR; that the project would have significant adverse <br />impacts on the environment pertaining to unstable soils, runoff <br />pollution, noise, air pollution and street maintenance but that <br />recommended conditions of approval of case PUD-79-13 would reduce those <br />impacts to an insignificant level; and that there are two significant <br />adverse impacts of case PUD-79-13 which are not mitigatable (traffic <br />increase on Valley Avenue and other access routes and impacts on <br />Valley Avenue/Santa Rita Road intersection) but that there are <br />overriding social and economic considerations (more local jobs) which <br />make infeasible all mitigation measures identified in the EIR. <br />ROLL CALL VOTE <br />Ayes: Commissioners <br />Noes: None <br />Abstain: Commissioner <br />Geppert, Getty, Jamieson and Chairperson Doherty <br />Wilson <br />-9- <br />
