Mr. Harris explained the staff report stating the map conforms with the <br />PUD approval. He stated the staff report contains four conditions, one of <br />which includes 17 conditions of Engineering Services on an attached list. <br />The public hearing was opened. <br />Ron Archer, Civil Engineer, representing the property owners spoke on behalf <br />of the project. He stated they concurred with the staff report. Concerning <br />item #3 it was suggested we contact the fire department. Mr. Archer <br />stated he has been in contact with Ted Klenk, the Fire Marshal and fire <br />hydrants, water line size, etc. will be worked out at the final design <br />stage. Mr. Archer stated he would be happy to answer any questions. <br />Dr. Howard Long, 363 St. Mary Street spoke. He stated he is in favor of <br />the project but would like to see some changes. He spoke to concerns with <br />a 48" diameter oak tree being removed. He stated he would like to see a <br />road going around this tree. He presented other photographs and diagrams <br />for the Planning Commission's review concerning items he would like to <br />see changed. He further stated that the report of Abel Soares dated <br />December 4, 1979 and the letter of Chuck Comstock dated November 2, 1979 <br />should be recorded as disclosure to all potential property owners so that <br />the buyers can be aware of all opinions governing this site. <br />Ron Archer, Civil Engineer, addressed all of the concerns of Dr. Long. <br />Dr. Long was given another five minutes to address the Commission and the <br />balance of his comments were rebutted by Mr. Archer. <br />The public hearing was closed. <br />Commissioner Leppert addressed the tree in the middle of the road. He <br />stated he would like to see the tree saved, but would not like to see a <br />traffic hazard created. He stated he has seen many bad accidents involving <br />autos hitting trees which are in the center of roadways. He further <br />addressed recordation of all reports and stated he would like to see the <br />Comstock report recorded. He stated it appears that Mr. Archer has <br />researched Lot 11 and made the appropriate change. <br />A motion was made by Commissioner Getty to approve Tentative Map Tract 4239, <br />subject to the conditions (#1-#4) of the staff report because all of the <br />required findings could be made. She stated this motion is to include the <br />17 conditions of the Engineering Services Department. She added a fifth <br />condition that "Full disclosure be made and that Comstock's letter of <br />November 2, 1979 and Abel Soares report of December 4, 1979 be recorded <br />and that if possible the oak tree near Lot 12 be saved;" and added another <br />condition requiring vehicular access to Lots 10 and 11 to be from the <br />"Private Roadway" not Longview Drive.
