James Brittingham, 7411 Alder Court, spoke in opposition to this use as <br />the court (Alder) is short and residents park in the court. He stated <br />this could cause a traffic problem as well as deteriorate the neighborhood. <br />Lawrence Goodwin, husband of the applicant, spoke assuring the Commission <br />that there would only be a few people coming in for their hair to be done. <br />He stated he wouldn't allow a large use at his home. <br />Commissioner Jamieson stated approving this use would be setting a prece- <br />dent for others and did not feel he could support this application. <br />The public hearing was closed. <br />Chairperson Doherty referred to Piano lessons previously considered. Mr. <br />Harris stated the concern of the Goodwin application is what it could <br />spawn i.e. the precedent it would set. <br />Chairperson Doherty stated Mrs. Goodwin did the right thing in applying <br />for a home occupation permit and pointed out that not everyone does. He <br />stated, however, that he supported the comments of his colleagues in <br />that it is not a proper home occupation. <br />Commissioner Leppert stated he concurred with Commissioners Jamieson and <br />Doherty. He stated he felt the applicants were sincere in their request <br />with regard to limiting their customers but as the staff pointed out we <br />cannot set a precedent and he cannot, therefore, support this appeal. <br />A motion was made by Commissioner Geppert, seconded by Commissioner Getty <br />that AP-79-13 be denied on the basis of the above testimony. <br />ROLL CALL VOTE <br />Ayes: Commissioners Geppert, Getty, Jamieson and Chairperson Doherty <br />Noes: None <br />Absent: Commissioner Wilson <br />Resolution No. 1840 was then entered and adopted denying the appeal of <br />Juanita Goodwin filed under AP-79-13. <br />Mrs. Goodwin was informed she has 15 days in which to appeal this decision <br />to the City Council. <br />Chairperson Doherty stated item 9a would be considered before items 7 and <br />8. <br />Tentative Map Tract 4239, Boatright and Goodrich <br />Application of Joseph Boatright and Ray Goodrich for tentative map approval <br />for Tract 4239, a subdivision of a 74.51 acre site into 28 (minimum one-half <br />acre) lots with a remainder of 50.64 acres left for open space. The site <br />is zoned HPD (Hillside Planned Development) District. <br />-4- <br />
