Commissioner Getty inquired about possible variances for fencing. <br />Mr. Oakes stated he has never been confronted with this possible situation <br />before so had no answers. Commissioner Getty stated that sometimes <br />this becomes a problem with narrow corner lots and the City has had to <br />consider variances in the past for similar circumstances. <br />Commissioner Jamieson stated he was not sure how he feels about a swap <br />regarding the bridge. <br />Mr. Oakes addressed this matter again stating he doesn't feel a bridge <br />is necessary now nor in the future and would rather see the money spent <br />for another need. He stated he would be in favor of a reasonable con- <br />tribution but suggested a limit be set as to his responsibility. <br />Jim Quinn, 3864 West Las Positas Boulevard, spoke in opposition to this <br />project. He stated traffic is a problem currently and there is no <br />guarantee that the Elliott portion will ever be built. He asked how <br />many lots would be lost by going to regular size corner lots vs PUD. <br />He stated 113 units is too many. <br />Mr. Oakes stated approximately 8-10 lots would be lost in response to <br />Mr. Quinn's question. <br />The public hearing was closed. <br />Commissioner Jamieson asked if there was any problem staff had with <br />Mr. Oakes request concerning condition #8 and the 2 ft. fill. Mr. Harris <br />stated the staff is asking for 2 ft. near the eastern edge of the pro- <br />perty. He stated that staff would agree to change the condition to <br />reflect "as agreed upon by an archaeologist expert." <br />Commissioner Getty asked how staff feels about moving the creek. <br />Mr. Harris stated Mr. Oakes would have to work with Zone 7 regarding <br />this. Mr. Harris stated that the general plan requires a bridge crossing <br />across the Mocho, but that the general plan could conceivably be changed <br />in the future. Mr. Harris stated Mr. Oakes could build a half a bridge <br />or contribute money toward half a bridge, either would be acceptable to <br />the City. <br />Mr. Schaumburg suggested that the developer contribute toward the bridge <br />and that the amount be resolved prior to approval of the tentative map. <br />Chairperson Doherty stated that a limit should be set at about $250,000 <br />for a contribution fee. <br />Commissioner Jamieson addressed item number 10 of the mitigated negative <br />declaration. <br />Mr. Harris explained B-2 would have to be issued sewer permits prior to <br />anyone on the B-3 list. <br />A motion was made by Commissioner Jamieson, seconded by Commissioner <br />Lindsey, that the mitigated negative declaration prepared for case <br />PUD-80-3 be recommended for approval. <br />-8- <br />_._... .._.____....._._.._...._.._,.. ___ _... __..., .... __. _..~.. _.r...».._..,.. ._. _.. .. ... _.~_... _.... .... __.. .. ~ .. _._ _ T ._. . <br />
