Commissioner Getty asked for the time frame, i.e. 8:00-3:30 p.m., 8-10 <br />children. Mrs. Tyrrell responded that some days there are six and that <br />the little ones sometimes nap from 1:00-3:00 p.m. Garvan presented a <br />photo of a lunch scene at the Tyrrell's and that his daughter has been <br />there since she was six months old and his daughter is now seven. He said <br />his daughter has received care as good as she would have at home. He said <br />that speaking as a Police Officer (not only for the City of Pleasanton) he <br />sees children left at home without proper supervision and that the Tyrrells <br />are fulfilling a need. <br />Mr. McKague spoke stating he is still opposed to the project, but if <br />approved would like to see the swing set moved to the north side of the <br />yard. Mr. Garvan stated his client would be happy to work with any <br />neighbors concerning mitigation measures. <br />Jim Jarrett, 1732 Harvest Road, spoke stating his main concern is still <br />safety for all children as well as pedestrian/autos using Harvest Road. <br />It appears there is not going to be a change in the variance requiring <br />they open their garage. This requires them to park in the street, etc. <br />He addressed the traffic on Harvest Road. <br />Ms. Spicka, 1748 Harvest, spoke stating she has lived in her house for <br />13 years. She stated that she has known Mr. and Mrs. Tyrrell during this <br />entire time and that to her knowledge there never have been any accidents <br />regarding children or cars and that she has no complaint with the noise <br />and that the neighborhood can accomodate this. <br />Denise Park, 1879 Halcyon, who lives directly in back of the Tyrrells says <br />they do not have any problems with the rabbit nor the noise of the <br />children. <br />R. Beniggno, 1792 Harvest, the Tyrrell's next door neighbor says his yard <br />is the closest to the applicant's and that children playing is a beautiful <br />thing and he likes it. He said there is no problems with an increase in <br />traffic in that the cars come at different times. He stated insofar as <br />property values dropping, his house has increased in value $50,000 in the <br />past two years. <br />The public hearing was closed. <br />A motion was made by Commissioner Doherty, seconded by Commissioner Getty <br />that all required findings can be made in approving UP-80-9 subject to <br />all of the conditions of the staff report of 6/11/80 removing condition <br />#7 and adding a condition that certain improvements be made to the back- <br />yard so that the dust will be kept to a minimum. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Getty, Jamieson and Chairperson Wilson <br />Noes: None <br />Abstain: Commissioner Lindsey <br />Resolution No. 1879 was then entered and adopted approving case UP-80-9 <br />subject to the staff reports with the changes as stated in the motion. <br />-4- <br />_.... _..t....r......~...._ ~ .. _...._....._..... ,., . ,. _... .. ._._., ~ _.. ._. _ _.__..T..,.. ...-_. .. <br />
