Commissioner Doherty made a motion, seconded by Commissioner Lindsey <br />that all required findings can be made and that this application be <br />approved subject to the staff report of October 8, 1980. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Getty, Jamieson, Lindsey and <br />Chairperson Wilson <br />Noes: None <br />Resolution No. 1912 was then entered and adopted approving case <br />UP-80-20. <br />Mr. Doyle was advised he can appeal this decision within 15 days to <br />the City Council. <br />UP-80-21, Larr Ste <br />App ication o Larry F. Stepp for a conditional use permit which <br />would allow swimming pool sales, supplies and/or services proposed <br />to be located at 201 Spring Street. The property is zoned C-C <br />(Central Commercial) District. <br />Mr. Harris explained the staff report recommending approval of the <br />application but eliminating that portion of it which deals with a <br />contractor's storage yard inasmuch as the findings cannot be made <br />to grant this portion of the application. <br />The public hearing was opened. <br />Larry Stepp, 4874 Woodthrush, the applicant, addressed the Commission. <br />He stated he concurs with everything on the staff report but not with <br />regard to storage of equipment. He stated he builds from 25-30 pools <br />per year and there would be a like amount of trips made by his equip- <br />ment so there would not be a traffic problem. He addressed the setbacks <br />which allow his equipment to turn around within the site. He further <br />stated his equipment would use I-680 to Sunol Boulevard and then go <br />directly to the property. He stated he would not be travelling <br />Main Street. He addressed the Deetz business and others ~tho go right <br />through town. He stated his equipment leaves about 7:30 a.m. and <br />doesn't return until 6:30-7:00 p.m. He further stated his equipment <br />leaves and returns empty and, therefore, would weigh less than other <br />equipment travelling the area. He also stated he wants to upgrade <br />the property in appearance. He stated his equipment could only be <br />seen from the second story roof next door and he doesn't consider <br />this to be obtrusive. <br />Commissioner Getty asked Mr. Stepp where the business is head- <br />quartered at this time. Mr. Stepp stated his business is operated <br />from School Street but that his equipment is stored on Scarlett <br />Court in Dublin. He stated he has had many agencies looking for a <br />location for him for a long time and this site is the best site <br />for his type of business. He stated to purchase this property for <br />a residence would be of little value. <br />-9- <br /> <br />
