Pat Griffin, Hometown Brokers, Pleasanton, representing the sellers <br />of the property stated that the sale of the property is contingent <br />upon approval of the use permit. She spoke in support of this appli- <br />cation giving all her reasons. <br />The public hearing was closed. <br />Commissioner Lindsey stated they are well aware that trucks use <br />St. John Street and doesn't agree with those trucks being there <br />but didn't want to create this same circumstance on Spring Street. <br />Commissioner Getty stated she also agrees with this statement. <br />She said she realizes the importance of selling this property, but <br />a swimming pool construction yard is not a use desirable in the down- <br />town area. She stated the street has mixed uses but doesn't feel <br />comfortable with storage in the back but until something is done <br />with the street in the area this use would not be suitable. <br />Commissioner Doherty asked if the C-C District specifically prohibits <br />the use . <br />Mr. Harris stated, no; swimming pool sales are allowed but there <br />is no category for contractor's storage yard. He stated that if <br />you look at the purposes of the C-C District (shown on the staff <br />report) you will see that the equipment storage aspect of the appli- <br />cation does not meet the special purposes of the C-C District. <br />A motion was made by Commissioner Lindsey, seconded by Commissioner <br />Jamieson that case UP-80-21 be approved per the staff report. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Getty, Jamieson, Lindsey and <br />Chairperson Wilson <br />Noes: None <br />Resolution No. 1913 was then entered and adopted approving UP-80-21 <br />per the staff report. <br />Chairperson Wilson advised Mr. Stepp that he has 15 days from the <br />date of this hearing to appeal this decision to the City Council. <br />Commissioner Lindsey mentioned the visibility on the street. <br />Mr. Stepp stated again that his equipment can turn around on the <br />property and that there is plenty of room including access. <br />-10- <br />
