Pat Griffin, Hometown Brokers, Pleasanton, representing the sellers of the property stated that the sale of the property is contingent upon approval of the use permit. She spoke in support of this appli- cation giving all her reasons. The public hearing was closed. Commissioner Lindsey stated they are well aware that trucks use St. John Street and doesn't agree with those trucks being there but didn't want to create this same circumstance on Spring Street. Commissioner Getty stated she also agrees with this statement. She said she realizes the importance of selling this property, but a swimming pool construction yard is not a use desirable in the down- town area. She stated the street has mixed uses but doesn't feel comfortable with storage in the back but until something is done with the street in the area this use would not be suitable. Commissioner Doherty asked if the C-C District specifically prohibits the use . Mr. Harris stated, no; swimming pool sales are allowed but there is no category for contractor's storage yard. He stated that if you look at the purposes of the C-C District (shown on the staff report) you will see that the equipment storage aspect of the appli- cation does not meet the special purposes of the C-C District. A motion was made by Commissioner Lindsey, seconded by Commissioner Jamieson that case UP-80-21 be approved per the staff report. ROLL CALL VOTE Ayes: Commissioners Doherty, Getty, Jamieson, Lindsey and Chairperson Wilson Noes: None Resolution No. 1913 was then entered and adopted approving UP-80-21 per the staff report. Chairperson Wilson advised Mr. Stepp that he has 15 days from the date of this hearing to appeal this decision to the City Council. Commissioner Lindsey mentioned the visibility on the street. Mr. Stepp stated again that his equipment can turn around on the property and that there is plenty of room including access. -10-
