Commissioner Doherty asked if babysitters are still regulated by the State and County for six or less children. Mr. Harris stated, yes.' they are. Mrs. Zolfarelli presented letters and a petition in support of her application from her surrounding neighbors. She stated that Mr. Doyle, the person circulating the petition against her, has never made a complaint to her about the noise she creates with children in her home. She addressed Mr. Doyle's petition stating some of the neighbors said they signed it just because they were requested to do so, some did not understand what they were signing and some wanted their names removed. Commissioner Lindsey asked Mrs. Zolfarelli if she agreed with the staff report and she responded, that she did. Commissioner Doherty asked if Mrs. Zolfarelli has been operating a babysitting service up to this point. She stated yes she has been operating such a service for several months (about 7). Commissioner Jamieson said that the staff report mentions that Mr. Zolfarelli has a large dog and asked Mrs. Zolfarelli to respond. She stated that the dog is one used by her husband in canine patrol and is generally with her husband at work and when not with her husband it is a house dog but does have a separate section in the back yard which is fenced separately from the rest of the back yard. James Doyle, 3659 Platt, stated he is the person who circulated a petition with good response from all of his neighbors in opposition to this application. He stated that while he has never complained, the noise level is intolerable. He stated he didn't believe Mrs. Zolfarelli should be given a conditional use permit for 12 children inasmuch as he bought a home in a single-family neighborhood and wants it to remain so. He further stated the Pleasanton area has three commercial day care facilities, none of which are at capacity and that they provide supervised-certified day care and, therefore, doesn't believe Mrs. Zolfarelli also has to be allowed to do so. Commissioner Lindsey asked if Mr. Doyle's property was right behind Mrs. Zolfarelli's, he responded that it is. Commissioner Getty asked if Mr. Doyle had small children; he stated his children are 14 and 17 years of age but he has neighbors who have small children, however, a concentration of children at one home is just intolerable. Mr. Doyle stated the area is zoned single-family residential.
