Commissioner Getty .stated she feels the PUD-Commercial is going <br />to be more favorable to the homeowners than having C-F or C-C <br />zoning. <br />Commissioner Doherty addressed the traffic situation stating most <br />people will be using I-680/Foothill Road to get there and that <br />will continue regardless of the uses on the site. He stated there <br />is nothing that can be done about people living in the area going <br />down Pleasant Hill to Stoneridge Drive. He said he sympathized <br />with the homeowners concerning their dilemma. He stated C-F is <br />not appropriate for that site. He stated he concurs with the PUD/ <br />C-C zoning as suggested by the staff. He stated that PUD gives <br />the City more control over everything. Commissioner Doherty stated <br />hs isn't sure O (Office) would be appropriate for the area by itself <br />and stated he concurs with Commissioner Getty. <br />Commissioner Jamieson stated that PUD/C-C would be in the best <br />interest of the homeowners and agreed with the other Commissioners. <br />Commissioner Jamieson made a motion, seconded by Commissioner Getty <br />that case RZ-80-9 be recommended for approval as suggested in the <br />staff report. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Getty, Jamieson, Lindsey and <br />Chairperson Wilson <br />Noes: None <br />Resolution No. 1911 was then entered and adopted recommending <br />approval of RZ-80-9 per the staff report. <br />UP-80-20, Elaine Zolfarelli <br />Application of Elaine Zolfarelli for a conditional use permit for <br />a day care center for a maximum of 12 children to be located at <br />her residence at 3652 Hawaii Court South. The property is zoned <br />R-1-6500 (Single-Family Residential) District. <br />Mr. Harris explained the staff report stating that the planning <br />division had received a petition from the residents of Platt <br />Court but nothing from Hawaii Court South, and that subsequent to <br />the petition, Mrs. Burroughs called and asked to be removed from <br />the petition. Mr. Harris stated that staff has just been made <br />aware of state law wherein a person may babysit for six children <br />(other than her own) with no regulation whatsoever by cities, <br />including a City business license and that the City only governs <br />a babysitting service when there are 7 or more children receiving <br />day care when the children do not reside in the home. He stated <br />that Mrs. Zolfarelli has been apprised of this but is asking for <br />a use permit to allow her to take care of seven or more children. <br />-6- <br />_.. _ _ <br />.... <br />
