Russ Tereau, 4141 Payne, spoke in opposition to this application. <br />He said property would become downgraded if the use were allowed. <br />John Jefferson, 4016 Crest Court, stated he lives behind the <br />latter of the two applicants, however, in both cases he is opposed <br />to more children in the area. He stated the lots are too small to <br />handle 12 people in one place. <br />Terry Berdeau, 4219 Payne stated up to 6 would be okay but not 12 <br />and that this case is no different than the Valley Empire Roofing home <br />occupation denied earlier in the evening. <br />The public hearing was closed. <br />Commissioner Jamieson stated that the City has no control of six or <br />less children being cared for in homes. <br />A motion was made by Commissioner Jamieson to deny this application. <br />The motion died for lack of a second. <br />Commissioner .Getty stated day care centers are becoming more and more <br />common and are needed to service the neighborhood in which they are <br />located and that it is completely different from a roofing company. <br />Commissioner Getty moved for approval of case UP-80-36 subject to the <br />7 conditions of the staff report because findings A, B, and C, as <br />enumerated in the staff report can be made. <br />Commissioner Lindsey stated the Commission has had the opportunity to <br />review many applications like this in the last several months. He <br />said that perhaps UP-80-36 and UP-80-37 are unique in that they are a <br />little too close to each other. <br />Commissioner Getty's motion died for lack of a second. <br />A motion was made by Commissioner Jamieson, seconded by Commissioner <br />Lindsey that the required findings could be made and that case UP-80-36 <br />be approved subject to the conditions of the staff report, changing <br />condition number 1 to reflect approval for 7 children and not 12 as <br />requested and that this approval is granted for a period of six months <br />at which time it will be reviewed by staff and a report of that review <br />furnished to the Planning Commission for their information. <br />Commissioner Doherty stated that the County representatives tell us <br />there is a great need for these types of facilities. He stated he <br />would be inclined to deny the application without prejudice and ask <br />staff to get together with the City Attorney, City Council to review <br />day care centers in the R-1 districts and other areas. <br />Mr. Doherty stated long range planning should be considered including <br />the assistance and input of the Human Services Commission and others. <br />Chairperson Wilson stated he was not in support of a motion to deny <br />because they already have 6 children. <br />-6- <br />
