Mrs. Reali stated she was under the impression she could get approval <br />for her use permit by agreeing to do whatever is necessary to make <br />her illegal structure comply with code. Mr. Harris stated that <br />condition number 7 of the staff report takes care of this matter. <br />The public hearing was opened. <br />Ron Allen, 6519 Singletree, spoke in opposition to this use. He stated <br />he had received two mailers; one for UP-80-36 and one for UP-80-37, one <br />addressed to his personal attention and one addressed to occupant. He <br />stated 12 children are too many for the site. He said he has circulated <br />petitions against the use. He cited traffic, noise, devaluating pro- <br />perty values as adverse impacts on the area and that the petition <br />contained 84 signatures. He asked that the petition be held 'con- <br />fidential.' He stated he purchased his house at the location where <br />it is so that he would not have to put up with noise and traffic as <br />in the areas of Donlon school, I-680 or off Hopyard. He presented <br />photographs depicting the property relationships. <br />Bobby Allen, 6519 Singletree, spoke in opposition to this request. <br />She said they were only able to contact 58 homes and three of these <br />people were in doubt and 50 opposed. She said further there is <br />another day care center at 3987 Empire Court who is licensed. She <br />said while the day care center might benefit 24 families at the very <br />most, but does nothing for the rights of the other 50 residents. <br />She stated there are balls over the fences, rocks thrown on the roof, <br />and broken fences because of the children at this time and she desires <br />to keep her property nice and free from these annoyances. She said <br />in the summer she has to keep her house closed because of the noise <br />level and urged consideration of her well being and safety. <br />Commissioner Doherty stated great concerns with a petition addressed <br />to be kept 'confidential.' <br />Mrs. Reali, 3968 Empire Court, spoke explaining her application. She <br />stated at the current time she wants to be able to take care of 7 <br />children and that is over the limit. <br />Chairperson Wilson asked why charts containing the schedules of the <br />children, etc. were not submitted with the application. Mrs. Rea1i <br />stated they were presented with her application but for some reason <br />not made part of the staff report. She stated there are letters from <br />mothers of the children who she watches, charts, etc. <br />Commissioner Doherty expressed concern again with a confidential type <br />petition. <br />Louisa A. Perry, 6809 Siesta Court, spoke stating she is a Val Vista <br />resident and didn't believe 12 children would be a problem with regard <br />to noise, damage of property, etc. She stated there currently is <br />no traffic problem. She said one of her neighbors have five children <br />and they have sometimes 7 or more playing with them and it is not <br />a babysitting service. <br />-5- <br />
