Beer cans, paper litter causing fleas, etc. are present; <br />mice, ladders extending from the trucks blocking sidewalks <br />and walkways (especially at night with lack of lighting), <br />mixing tar on trucks, three vehicles being parked, workers <br />standing around, workers sitting in their trucks on the <br />frontage road as well as Corte Sierra, suspicious individuals <br />about the premises not using walkways but going behind bushes; <br />10 children live in the court and their safety is being <br />jeopardized; large number of trucks in the a.m., storage <br />of supplies and materials in the garage and yard. <br />Mr. Helbrook presented polaroid photographs to the Commission for <br />perusal showing that the vehicles are also parking in the wrong <br />direction on the frontage road. <br />The public hearing was closed. <br />A motion was made by Commissioner Doherty, seconded by Commissioner <br />Getty that AP-80-11 be denied and that Valley Empire Roofing, Inc. <br />be given no more than thirty (30) days to remove their business from <br />the premises entirely. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Getty, Jamieson, Lindsey and <br />Chairperson Wilson <br />Noes: None <br />Resolution No. 1922 was then entered and adopted denying the home <br />occupation permit for Mr. and Mrs. Torres' Valley Empire Roofing <br />business as filed under AP-80-11. <br />UP-80-36, Faris A. Reali <br />Application of Faris A. Reali for a conditional use permit for a day care <br />center for a maximum of 12 children to be located at her residence at <br />3968 Empire Court. The property is zoned R-1-6500 (Single-Family <br />Residential) District. <br />Mr. Harris presented the staff report and recommendation to approve <br />the request. <br />Commissioner Getty stated that there are two cases being heard tonight <br />(UP-80-36 and 37) and the homes are in close proximity to one another. <br />Faris Reali, 3968 Empire Court spoke. She stated that with regard to <br />her illegal structure, they plan to make the structure legal even <br />if a variance is not granted. <br />Commissioner Lindsey asked if the structure could be modified. <br />Commissioner Doherty pointed out to the applicant that the variance <br />would not be going before the Board of Adjustment for another month <br />and that it may or may not be approved and that the time frame might <br />be a problem for the applicant. <br />-4- <br /> <br />
