UP-80-35, Marcia Myer: <br />Application of Marcia Myers for a conditional use permit which would <br />allow the operation of a cocktail lounge at the newly constructed <br />commercial center located in the northernmost building at the corner of <br />Hopyard Road and Valley Avenue. The site is zoned C-C (Central Commercial) <br />District. <br />Mr. Harris explained the staff report and concerns with parking for <br />this type of business. <br />Chairperson Wilson stated that the developer was made aware there was <br />too much building for the site when the approval for the building was <br />granted but kept saying the types of businesses proposed (specialty <br />shops) would not encumber the parking. <br />Commissioner Getty stated that at night there is an abundance of <br />teenagers hanging out at the Community First National Bank at the <br />corner of this property. She expressed traffic concerns and stated <br />this is not a proper location for a bar. <br />Commissioner Doherty stated that as a practical standpoint, he didn't <br />see them having a lot of business before 4:00 P.M. during the week <br />especially since they will not be serving food and would not like to <br />see this business tied to a 5:00 P.M. opening time. <br />Chairperson Wilson reiterated that a bar is not the main concern <br />but rather parking for this type of business. He said the developer <br />was advised at development approval stage the parking was tight <br />and his uses would be or could be limited because of too much building <br />for the land. <br />Mr. Harris stated that the City is going to keep an eye on the uses for <br />parking. <br />Commissioner Lindsey stated that conceivably specialty shops could <br />stay open to 9:00 P.M. <br />Commissioner Getty stated that a 7-11 type of business could really be <br />a problem. <br />Jim Pindel spoke, representing Marcia Myers, the applicant. He stated <br />they agree with everything the staff has recommended except for the hours <br />of operation. He said that as a business man you have to be open a <br />certain amount of the time and assured the Commission he is not in the <br />food business. He explained the cocktail lounge business, hours of <br />operation required and amount of time clientele spend at the bars. <br />Commissioner Getty asked Pindel if he was having music. Mr. Pindel <br />stated he wasn't but that he would like to have a Polynesian review <br />once a month. <br />Commissioner Getty argued that if there aren't many customers during <br />the day what is the reason the business must stay open. She said her <br />business is across from three bars and people come very early and <br />leave late. <br />-12- <br />~.. . <br />
