He stated there is an over abundance of office space in the area <br />citing the new proposal of Southern Pacific Railroad Land Company as <br />being a significant one. <br />Commissioner Getty said that the most logical place to put C-C District <br />is in the core area and it doesn't make sense to allow it over the <br />entire City. <br />The public hearing was opened. <br />The applicant, Jim Lavey, addressed the Commission. He stated their <br />goal is not to change the building, but that they just want to be able <br />to have their own mortgage business in it. He said most of his tenants <br />are in the process of vacating. He stated his business would take up <br />less parking than the other businesses which occupied the site. Con- <br />cerning 'spot' zoning he said this building is surrounded by C-C zoning <br />and if anything it is currently 'spot' zoned. <br />Chairperson Wilson then asked him how much area of the building he would <br />be occupying and Mr. Lavey answered. Discussion then ensued concerning <br />a change in zoning to C-C making some of the tenants non-conforming. <br />Mr. Lavey said that the motorcycle business would be the only business <br />non-conforming because the other businesses are either out, moving out <br />or planning to move out in the future. <br />Commissioner Lindsey asked about ownership of the building and Mr. Lavey <br />responded. <br />The public hearing was closed. <br />Commissioner Jamieson asked if the Laveys occupied space in downtown <br />Pleasanton at this time. Mr. Lavey responded they occupy space on <br />Hopyard Road. Commissioner Jamieson stated that small business needs <br />should be supported. <br />A motion was made by Commission Jamieson, seconded by Commissioner Getty <br />that the negative declaration prepared for case RZ-81-1 be recommended <br />for approval. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Getty, Jamieson, Lindsey and <br />Chairperson Wilson <br />Noes: None <br />Resolution No. 1950 was then adopted recommending approval of the negative <br />declaration prepared for case RZ-81-1. <br />A motion was then made by Commissioner Jamieson, seconded by Commissioner <br />Getty that case RZ-81-1 be recommended for adoption. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Getty, Jamieson, Lindsey and <br />Chairperson Wilson <br />Noes: None <br />Resolution No. 1951 was then entered and adopted recommending approval of <br />case RZ-81-1. <br />-6- <br /> <br />
