Discussion then ensued between Chairperson Wilson, Mr. Harris and <br />Mr. Swift concerning septic tanks. Mr. Swift said that Mr. Canessa's <br />property is using a septic tank that the Berry Farm had. Mr. Swift <br />stated an alternative would be a holding tank which would require City <br />Council and County Sanitation approval. Chairperson Wilson stated <br />that Conditions No. 5, 6, 8 and 9 would be very expensive to the pro- <br />perty owner. Mr. Swift stated that as a general rule these conditions <br />are allowed if they are reasonably related to the impact of that <br />particular use and that if the Planning Commission finds the traffic <br />on Stanley would be increased, the conditions are reasonable. <br />Chairperson Wilson asked if Mr. Avilla, the property owner, was present. <br />Mr. Avilla addressed the Commission. <br />Chairperson Wilson asked Mr. Avilla if he understands the conditions <br />which were recommended by staff and which would be imposed if the <br />rezoning were approved. Mr. Avilla stated he is aware of the con- <br />ditions but at the current time cannot afford to dedicate property <br />and pay for the items mentioned. <br />Commissioner Getty asked when the dedication would have to be made and <br />Chairperson Wilson stated the dedication would have to be now. <br />Mr. Asbill stated he couldn't see that it would be necessary to have <br />a lane constructed for turning at this time. <br />Chairperson Wilson summarized the applicant's concerns, basically that <br />the only conditions recommended that they concur with are Conditions <br />Nos. 1 and 7. <br />Commissioner Getty stated that under the circumstances she feels the <br />property owner doesn't really understand the conditions staff recom- <br />mends concerning the required improvements and that for this reason <br />she would not be supportive of the application and request for rezoning. <br />She said she concurs with the staff report. <br />A motion was made by Commissioner Getty, seconded by Commissioner Lindsey <br />to deny case RZ-81-6 without prejudice. <br />ROLL CALL VOTE <br />Ayes: Commissioners Getty, <br />Noes: None <br />Absent: Commissioners Doherty <br />Lindsey and Chairperson Wilson <br />and Jamieson <br />Resolution No. 2000 was then entered and adopted denying case RZ-81-6 <br />without prejudice. <br />UP-80-17, Jeanne Baker <br />Review of conditional use permit allowing rabbits on the property at <br />6387 Alvord Way.
