Newnam <br />App ication o Bi y R. Newnam to rezone a 5.1+ acre site located at <br />5130 Foothill Road from "Agricultural" to "R-1-40,000",(Single-Family <br />Residential) District or to any other zoning district consistent with <br />the General Plan. A negative declaration of environmental impacts was <br />also considered. <br />Mr. Harris explained the staff report and recommendation for approval. <br />Mr. Harris stated originally Mr. Newnam came in for a lot line adjust- <br />ment so he could get the lot line away from a horse barn and that the <br />1.78 acres lot has Mr. Newnam's home on it and 3.36 acres is presently <br />vacant with a portion of the barn on it. <br />The public hearing was opened. <br />Mr. Newnam addressed the board stating he would be happy to answer any <br />questions and that he has no intentions of subdividing -- he doesn't <br />care for neighbors. <br />Mr. Harris read the letter of opposition by Franklin and Dorothea <br />Greves, neighbors of the Newnam's. <br />Gerald Listman, 4884 Treewood Court, spoke in opposition to the rezoning <br />with his main concern being an increase in traffic. He stated the <br />property is located on one of the worst curves on Foothill Road. He said <br />a car came onto his property from Foothill Road and just missed the <br />bedroom with his wife in it. He spoke to drainage and water concerns <br />stating his backyard gets a lot of water. <br />Commissioner Lindsey asked if Mr. Listman's primary concern was with <br />additional development or just the property being addressed tonight. <br />Mr. Listman said that any new development is going to be trouble to <br />someone living below the area. <br />Gil Barbee,l47 Bernal Avenue spoke on behalf of Mr. Newnam stating that <br />this is merely a rezoning application to cover a lot line situation, <br />that the Newnam home is already in existence and that on the vacant <br />parcel Mr. Newnam can build a home without the rezoning stating the <br />desire is to take .8 ac. and add it to his 3.3 acres, keeping 4 acres <br />for himself and just sell one acre and keep his horse operation on the <br />larger parcel. <br />Mr. Listman said the notice refers to a zoning change from Agricultural <br />to R-1-40,000 and to him that means development.
