UP-81-13, Bruce and Antoonette M. Gach <br />App ication o Bruce and Antoinette M. Gach for a conditional use <br />permit which would allow them to maintain up to four rabbits at <br />their residence located at 2742 Longspur Way. The property is <br />zoned R-1-6500 (Single-Family Residential) District. <br />Mr. Harris explained the staff report and recommendation of approval <br />subject to certain conditions. <br />Commissioner Lindsey asked Dr. Gach if he were agreeable to moving <br />the hutches pursuant to one of the conditions and Dr. Gach agreed. <br />The public hearing was opened. <br />Woody Pereira, 43 Golf Road, spoke in opposition, but stated he <br />would remove opposition if certain modifications to the cages were <br />made regarding removal of droppings. He also felt the cages should <br />be equidistant from the neighbors and should be a minimum of 20 ft. <br />from the fences, not 10 ft. <br />Dr. Gach stated he would be willing to make the changes, but that <br />he could not gaurantee the 20 feet as it would place some of the <br />cages in the sunlight, which would kill the rabbits. <br />The public hearing was closed. <br />A motion was made by Commissioner Doherty, seconded by Commissioner <br />Jamieson, to approve Case UP-81-13, subject to the four conditions <br />in the staff report and stipulating that Dr. Gach will try to move <br />his cages more than 10 feet and made findings a, b, and c from the <br />staff report. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Jamieson, Lindsey, Wilson and <br />Chairperson Getty <br />Noes: None <br />Resolution No. 2018 was then entered and adopted approving Case UP-81-1.3. <br />OLD BUSINESS - Public Hearings <br />PUD-81-7, Foothill Knolls <br />App ication o Foot i Knolls for development plan approval for <br />an 85 lot low density residential planned unit development proposed <br />for the 43 acre site located on the east side of Foothill Road <br />approximately 830 feet south of the City limit line. The property <br />is zoned PUD-Low Density Residential District. A mitigated negative <br />declaration of environmental impacts was also considered. <br />Mr. Harris explained the staff report and the changes made between <br />the original plan and the revised one. First, rather than have the <br />houses face the I-680 highway, the developer proposes to dedicate a <br />portion of land which would form a linear park with improvements <br />between the eastern side of the property and the first street in the <br />development so that houses would face the park with the freeway on <br />the otherside, Staff feels this would help with design and noise <br />problems. <br />-2- <br />_. _.. .._...._ .._T.,,.~..__.__. _ ._._.. _... _.__._.... _... _, .. _.. _._.... _. __. _._,.... .. ..... ,_. _....... _. <br />
