ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Jamieson, Lindsey, Wilson and <br />Chairperson Getty <br />Noes : I1one <br />Resolution No. 2046 was then entered and adopted approving case <br />UP-81-20 as petitioned. <br />Development Agreement - Kaiser Foundation Health Plan, Inc. <br />Application of Kaiser Foundation Health Plan, Inc. for development <br />agreement for their 19 acre site located at the southwest corner of <br />Springdale Avenue and Stoneridge Mall Road. <br />Mr. Harris stated that Brian Swift, City Attorney's office, is present <br />to answer any questions concerning this matter. <br />The public hearing was opened. <br />Mark Jordan, Kaiser Foundation Health Plan, Inc., One Kaiser Plaza, <br />Oakland, spoke stating he is the co-author of the agreement and stated <br />there are a couple of typographical errors in the staff report. He <br />said the 5.4 acres should be 19 acres and that in paragraph 4 Phases <br />II and II should be changed to "Phases II and TII" and the second line <br />of that same paragraph should be changed from Phase II" to Phase III." <br />Mr. Jordan urged a recommendation of approval. <br />The public hearing was closed. <br />Commissioner Lindsey made a motion to recommend approval of the <br />development agreement. <br />Commissioner Jamieson then asked if there was a three-story height <br />limitation. 1~1r. Harris explained that as a result of the homeowners' <br />concerns there is an agreement on height limitation. Mr. Harris <br />further pointed out that this is the second development agreement <br />before the Commission and he emphasized that by approval, the agree- <br />ment gives the developer privileges which they do not currently enjoy. <br />He said this particular agreement isn't precedent setting and staff <br />recommends approval, however, others may come in requesting the same <br />thing and the Commission should take a close look at each one and <br />that an agreement might not be appropriate in other instances. <br />Commissioner Lindsey's motion was seconded by Commissioner Doherty. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Jamieson, Lindsey, Wilson and <br />Chairperson Getty <br />Noes: None <br />Resolution No. 2047 was then entered and adopted recommending approval <br />of the development agreement for Kaiser Foundation Health Plan, Inc. <br />-11- <br />_. . <br />
