Commissioner Doherty also felt the applicants are sincere but doesn't feel <br />the location to be appropriate because the clientele (youth) would be <br />put in close proximity to some of the 'unholy element' of our society, <br />congestion and possible loitering; and that because of the 'cruising' <br />and peer pressure more congestion might occur causing a traffic problem <br />and the location is just not environmentally proper for the use. He <br />suggested that perhaps the applicants could look at other areas not next <br />to bars or where people do not tend to loiter. <br />Commissioner Jamieson stated he feels that a video game room would be a <br />'hang out' and could not support the application. <br />A motion was made by Commissioner Lindsey, seconded by Commissioner Doherty, <br />that case UP-81-27 be denied because 525 Main Street is not a proper <br />location for the proposed use and appropriate findings cannot be made to <br />support the applicant's request. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Jamieson, Lindsey, Wilson and <br />Chairperson Getty <br />Noes: None <br />Absent: None <br />Abstain: None <br />Resolution No. 2075 was then entered and adopted denying case UP-81-27 as <br />petitioned. <br />The applicant was advised they have 15 days in which to appeal this <br />decision to the City Council. <br />RZ-81-20, Hempy and Starnes <br />Application of Harry and Evelyn R. Hempy and Robert and Margaret Starnes <br />to rezone an approximately 9 acre area located on the west side of <br />Foothill Road north of Highland Oaks Drive in the vicinity of 5050 and <br />5100 Foothill Road from the A (Agricultural) to the R-1-40,000 (Single- <br />Family Residential) District or to any other zoning district consistent <br />with the General Plan. A negative declaration of environmental impacts <br />was also considered. . <br />Mr. Harris reviewed the staff report and recommendation of PUD-Low <br />Density Residential District. <br />Commissioner Lindsey asked if everyone had received a copy of the letter <br />from the Williams who are neighbors to the property in the application. <br />Mr. Harris stated all of the Commissioners have a copy and also that <br />he has read it. <br />The public hearing was opened. <br />Rich Hempy, 201 Spring Street, son of the applicant, urged approval <br />of the request and asked for clarification regarding PUD zoning. <br />Mr. Harris explained. He stated that it is their intention for <br />another brother/sister to also build on the site. <br />-7 - <br /> <br />
