Commissioner Jamieson asked if the Hempy land is on both sides of <br />the easement and Richard Hempy said it was. <br />Fred Hempy, Oakland, urged approval of the rezoning so he could also <br />build a home on the property. <br />The public hearing was closed. <br />A motion was made by Commissioner Lindsey, seconded by Commissioner <br />Wilson that the negative declaration prepared for case RZ-81-20 <br />be adopted inasmuch as this zoning change would have no significant <br />adverse effect on the environment. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Jamieson, Lindsey, Wilson and <br />Chairperson Getty <br />Noes: None <br />Absent: None <br />Abstain: None <br />Resolution No. 2076 was then entered and adopted recommending approval <br />of the negative declaration prepared for case RZ-81-20. <br />A motion was made by Commissioner Wilson, seconded by Commissioner <br />Lindsey, that the property described in case RZ-81-20 be zoned PUD- <br />Low Density Residential District and that this zoning is consistent <br />with the General Plan subject to the two conditions shown in the <br />staff report of 10/14/81. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Jamieson, Lindsey, Wilson and <br />Chairperson Getty <br />Noes: None <br />Absent: None <br />Abstain: None <br />Resolution No. 2077 was then entered and adopted recommending PUD- <br />Low Density Residential zoning for the property described in case <br />RZ-81-20 subject to the two conditions in the staff report dated <br />10/14/81. <br />PUD-81-21, CPS & Associates <br />Application of CPS and Associates for a major modification to their <br />approved planned unit development (PUD-80-1) which would change the <br />streets in the development from private to public on their 69 acre site <br />located east of Kolln Street and south of Valley Avenue. <br />Mr. Harris reviewed the staff report and recommendation of approval. <br />Commissioner Jamieson asked if the streets were made public what the <br />cost would be to the citizens. <br />Mr. Harris stated it is the developer's intention to create a mainte- <br />nance fund and would pay for the maintenance of the streets for 10 years. <br />He stated this is the same as required of the Reynolds and Brown as well <br />as the Meyers projects.
