Mr. Harris presented the staff report recommending approval. <br />The public hearing was opened. <br />Lee Babbitt, Woodhill Development Company, stated he has reviewed the <br />staff report and is in accord with the conditions thereon. <br />No one else addressed the Commission. <br />The public bearing was closed. <br />A motion was made by Commissioner Lindsey, seconded by Commissioner <br />Doherty, that approval of case UP-81-26 would have no adverse signi- <br />ficant effect on the environment and that the negative declaration <br />prepared be adopted. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Jamieson, Lindsey and <br />Chairperson Getty <br />Noes: None <br />Absent: None <br />Abstain: Commissioner Wilson <br />Resolution No. 2079 was then entered and adopted approving the negative <br />declaration prepared for case UP-81-26 as motioned. <br />A motion was made by Commissioner Lindsey, seconded by Commissioner <br />Doherty, that findings A-C in the staff report are made and that <br />case UP-81-26 be approved as shown in the staff report of 10/28/81. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Jamieson, Lindsey and <br />Chairperson Getty <br />Noes: None <br />Absent: None <br />Abstain: Commissioner Wilson <br />Resolution No. 2080 was then entered and adopted approving case <br />UP-81-26 as motioned. <br />PUD-81-28, Axiom Group <br />Application of Southern Pacific Transportation Company for development <br />plan approval of an approximately 70,000 sq. ft. commercial/office <br />development to be located between First Street and the SPRR right- <br />of-way from Angela Street to the extension of Bernal Avenue and <br />between Neal Street, Angela Street, the SPRR right-of-way and a line <br />approximately 250 ft. east of Main Street, and rezoning of the site <br />to PUD-Commercial/Offices, also to rezone the DeLucchi and <br />Wayside parks located on the west side of First Street between <br />Angela Street and a point approximately 350 ft. north of Neal Street <br />from C-C (Central Commercial) to PUD (Planned Unit Development- <br />Open Space, Parks and Recreation) or to any other zoning district <br />consistent with the General Plan. The property is zoned C-C (Central <br />Commercial) and O (Office) Districts. A mitigated negative declaration <br />of environmental impacts was also considered. <br />-3- <br />
