Marshall Snover, one of the complainants and a neighbor to the use <br />in question and urged that it be abated inasmuch as he bought his <br />home in March 1981 unaware of the use and at that time came to the <br />Planning Division and determined what the zoning was for the area. <br />He said he was assured the area was zoned "A" (Agricultural) District. <br />He indicated that immediately after moving in he noticed that each <br />morning at 5:30am-6:OOam a regular caravan of heavy equipment left <br />1851 Rose Avenue making a lot of noise. He also indicated he was <br />unaware this business caas next to him because he had never been <br />there so early in the morning. He said he is paying a penalty by <br />having this use next to his home. He indicated an easement is <br />shared between his residence and the business and if he had small <br />children they could conceivably be struck by one of these pieces <br />of heavy equipment. He said the easement is only 16' wide and having <br />industrial equipment move on it is an absurdity. He said the use <br />creates noise pollution and air pollution. He-said other neighbors <br />in the immediate area concur with his concerns. <br />Richard Glenn, Assistant Planner, said the operator of the use at <br />1851 Rose Avenue, John Altieri, claims that he has been storing and <br />repairing equipment for seven years but that all the neighbors <br />contend it has only been going on for about 18 months. <br />Commissioner Getty asked Mr. Snover if there was a lot of noise <br />emitted from CanAm Plumbing an adjacent business on the Fairgrounds <br />property. r'Ir. Snover said there is no noise at all from this use. <br />He further said one of his neighbors, Mr. Jones, has a crane business <br />which he operates from his home which disturbs no one either, but <br />that the Skinner/Altieri business causes welding to be done at 1:OOam <br />and other things which cause noise, traffic problems and air pollution. <br />Commissioner Lindsey indicated he jogs in the area early in the <br />morning and has noticed a caravan of trucks going down Rose Avenue <br />and wasn't aware of the location from which they were coming. <br />Mr. Ernest Jones, 1725 Rose Avenue, said he has lived at this <br />location for 18 years and has had his business at this location for <br />14. He indicated that for the past three years they have been phasing <br />out their business and now only operate one crane from the site. <br />He objected to the obnoxious manner in which i~Ir. Altieri operated his <br />business. <br />A motion was made by Commissioner Jamieson, seconded by Commissioner <br />Doherty that no changes to the "A" (Agricultural) District be initiated. <br />-ROLL CALL VOTE <br />Ayes Commissioners Doherty, Jamieson, Lindsey, Wilson and <br />Chairperson Getty <br />Noes None <br />Absent None <br />Abstain None <br />Resolution No. 2111 was then entered and adopted that the request <br />for the additional uses in the "A" (Agricultural) District be denied. <br />-14- <br />
