P/C <br />Page 6 <br />2/23/83 <br />Mr. Tandowsky, 1927 Foxswallow Circle, spoke to the tree issue. He stated there is <br />a cottonwood tree on the property which he hoped would be removed. He further <br />addressed Condition No. 23 relating to sidewalks and asked if any consideration has <br />been made for sidewalks to go to Blackbird. Chairperson Lindsey told Mr. <br />Tandowsky that one could not expect the developer of this project to pay for side- <br />walks all of the way to Blackbird as it wouldn't be fair. Mr. Randowsky further <br />requested that in view of the density and vehicle trips projected, they would like <br />a wall to be used as a noise barrier along Valley Avenue which would be more <br />permanent in nature and further debris, etc. is always getting in the yards of <br />the residences on that street. <br />Laurie Burns, 2196 Tanager, addressed Condition No. 64 and requested that <br />construction hauling not be allowed on Tanager and wants construction trucks <br />to use Valley Avenue and Santa Rita Road. <br />Les Levi, 1935 Foxswallow, asked if there was a walkway on the southwest corner. <br />Mr. Mogensen responded that there would be a 20' one way exit for emergency <br />access. Mr. Levi asked if there is something which can be done to assure it <br />will not be used. Chairperson Lindsey stated that the new fence will be substantially <br />better than what is there now. He indicated that the Commission has had discussion <br />concerning the fencing along Valley Avenue but it is not part of this project. <br />Commissioner Jamieson asked if there is any way to control the 20' exit for <br />emergency use only. Mr. Warnick felt that if this is a real concern of the <br />neighbors that it might be desirable to have a masonry wall for this section <br />rather than a regular fence. Mr. Matteson said they have no objection to the <br />installation of a masonry fence on the west side of the property line in this <br />location. <br />The public hearing was closed. <br />Chairperson Lindsey said it really helps when developers talk ahead to the <br />surrounding property owners as they have done in this instance. <br />Commissioner Getty stated it would be unfair to have the developer pay for <br />sidewalks from Greenwood west on Valley Avenue to Hopyard Road. She said she <br />doesn't know why there wasn't any sidewalks installed on the north side to begin <br />with but it would be very unfair to expect this developer to do anything about <br />this situation. <br />Chairperson Lindsey said that for the residents on the west side of Greenwood <br />Road, there is access to Valley Avenue for children et al go to to Valley Avenue. <br />Commissioner Getty stated that inasmuch as the City is always trying to get <br />rental units for affordable housing she doesn't want this to be a condition imposed <br />on this development. Commissioner Doherty preferred to have a sidewalk down <br />Valley Avenue to Greenwood Road and felt if it isn't required now, it would <br />be lost. <br />-6- <br />
