P/C <br />Page 11 <br />2/23/83 <br />Mr. Harris presented the staff report. He indicated that "Open Space" has not <br />been defined yet under the General Plan and that staff feels that both with the <br />Martin and Dunkley proposal a lot of thought has gone into the plan paying particular <br />attention to the terrain. He said there will be more grading on the Mutual <br />Land property than with the Martin property but they are attempting to keep <br />grading to a minimum. He said there will be nothing greater than 12-122% slope <br />and that staff recommends approval. Mr. Harris further indicated that there has <br />been a study done covering about 1700 acres incorporating three properties <br />in the area concerning the water and circulation for the area. He said the <br />developers paid for most of the cost of the studies with the City paying the <br />balance. <br />Commissioner Getty asked if the Commission would get a copy of the completed <br />study. Mr. Harris said yes, it is tentatively scheduled fora general plan <br />amendment next year concerning the Circulation Element resulting from the study. <br />Commissioner Getty then asked if Crellin Road is extended how much cut and fill <br />would be required. Mr. Harris stated the study looked at this. Commissioner <br />Getty asked if staff thought Crellin Road will be used all that much and asked if <br />it is necessary to put it right through the project. Mr. Harris stated that the <br />staff is not proposing building a road network but that we want to know the <br />probable locations of the roads so that we can examine circulation of each <br />individual case. Commissioner Getty asked when this would be done. Mr. Harris <br />stated that with the extension of Crellin Road they have asked that the developers <br />dedicate right of way and requested that they enter into a deferred improvement <br />agreement with the City so that the improvements can be done when deemed necessary <br />by the City Engineer and that the City is not requiring that the street be <br />stubbed out at this time. <br />Commissioner Getty addressed Condition No. 3 in that only two lots would pay for <br />the additional 700' of paving. Mr. Warnick stated that it is the developers <br />responsibility to build roads on the site but in five years if not used, the <br />road would become a public nuisance so-they need to set-aside by agreement that <br />the improvements will be done now or in the future if needed. He stated that <br />in a deferment agreement the City. usually asks for the property owner closest <br />to the road to parti'ci'pate in the funding. Mr. Harris confirmed that there is <br />nothing unusual about this. Mr. Harris stated that other property~~nearby will <br />be coming out of the Williamson Act in 9 years. Mr. Warnick stated that a <br />deferment agreement must be tied to a particular piece of property. <br />Chairperson Lindsey asked who would buy Lots #10 and #11 with such a lien. <br />Mr. Swift stated the cost could be spread over other lots but that it makes <br />it more difficult to sell all of the lots instead of just two as in this case. <br />Mr. Warnick indicated that if the cost is spread over more lots, it makes more <br />people to negotiate with. <br />Commissioner Getty asked what would happen if the Circulation Study is not <br />approved. Mr. Harris stated that unless it is changed drastically, there should <br />be no problem. He further stated the report does not consist of a text but just <br />a series of maps. Commissioner Getty felt that the Commission should be provided <br />with the maps. Chairperson Lindsey said it would be nice to have the information. <br />-11- <br />
