He said this <br />helps in identifying a rural area. <br />Commissioner Arrigoni asked if the curb and gutter issue included sidewalks. <br />Mr. Warnick indicated it did not. <br />A motion was then made by Commissioner Getty, seconded by Commissioner Jamieson <br />that case PUD-82-16 be recommended for approval subject to the conditions shown <br />in the staff report with the following modifications: <br />7. That if a homeowners association is established for the development, <br />that the CC&RS for the homeowners association shall be submitted to <br />the City for review and approval prior to submittal of a final map and <br />that the City shall be named as third party beneficiary of the CC&RS <br />and granted the power to enforce their provisions if the homeowners' <br />association fails to do so. <br />20. This condition is proposed to be eliminated. <br />34. That except as modified by this development plan, the site and use <br />standards for the subject property shall be those of the R-1-20,000 <br />District. <br />48. That the on-site storm drainage swales on lots 10, 11, 12, 15 and 17 <br />shall be private and shall be privately maintained. <br />49. Zoning for the property is PUD (Planned Unit Development)-Low Density <br />Residential and Open Space District.
