PLANNING COMMISSION <br />Page 2 <br />4/13/83 <br />Mr. Hughes stated that he is having an auction with the Barter <br />Jubilee of Livermore. He indicated this auction would actually <br />barter goods and there are people in the audience from Livermore <br />to describe a barter auction if it is desired. <br />Chairperson Lindsey asked Mr. Harris if there is an application <br />on this. Mr. Harris indicated that Mr. Kinney telephoned and <br />asked about this condition because it was discussed when he <br />came before the Planning Commission originally. He wanted to <br />know what he could do to either approach the Commission or get a <br />change to allow an auction on another night. Initially, it was indi- <br />cated staff would put it on the agenda and discuss the matter. There <br />wasn't a staff recommendation that he not be allowed to have auctions <br />on other than Wednesday nights. The Commission had imposed this condition. <br />i~ir. Harris indicated that minor modifications to use permits do <br />not have to be advertised and can be done administratively but <br />since the Commission imposed this condition, it was felt that the <br />Commission should hear the request and make a decision on it. <br />He indicated that the staff has not received any complaints with <br />regard to the operation to this date and it wouldn't seem to staff that <br />i-F_ Mr. Kinney were to hold auctions on other dates, it would be <br />a problem. The concerns we expressed were that there might be <br />a lack of parking in the area if he had a very successful operation, <br />especially during the hours of the operation of other businesses in <br />the area. Staff feels Sundays and evenings would be no problem <br />in this regard. Mr. Harris suggested that there probably wouldn't <br />be a problem if Mr. Kinney wanted to hold other auctions three or <br />four times per month. <br />Mr. Hughes indicated that Mr. Kinney would like the discretion to <br />do it other times than just Wednesday when he receives merchandise <br />after it is marked. He said he would prefer not to have to come to <br />the City everytime he has merchandise available to sell. <br />Commissioner Wilson and Chairperson Lindsey discussed the number <br />of nights auctions are allowed. It was determined that currently <br />he has approval for one per week. <br />Commissioner Wilson made a motion to allow Mr. Kinney to have two <br />additional auctions per month providing they are either in the <br />evening or Saturday or Sunday and those two dates should <br />be approved by staff. <br />Mr. Harris indicated that in the original conditions there is a <br />requirement that there be an annual review anyway, so if he is <br />allowed to have these additional auctions at night and problems <br />develop, the Commission will have a chance to screen the use in <br />October 1983. <br />Mr. Hughes stated that before the Commission takes a vote he would <br />like to add that he believes there have been no problems with the <br />business. <br /> <br />
