MINUTES
PLANNING COMMISSIOPd
JULY 13, 1983
Page 4
Commissioner Lindsey believed that loitering and littering
would have to be policed continually by the applicant. He
further agreed with the applicant that Condition No. 2 should
be amended and that no loan officer would grant a loan for
purchase of equipment with that condition of approval imposed.
Chris Beratlis, 425 Main Street, supported the application.
He indicated that if the site would be used for office use,
there would be more permanent parking during the day which
would cause more of a parking problem than the use proposed.
Commissioner Lindsey asked Mr. Beratlis if there are any
problems with regard to the yogurt shop. Mr. Beratlis
indicated that ice cream does get on the walkway but that this
is really the only problem. He stated that they have garbage
pick up every other day. Commissioner Lindsey then asked
Mr. Beratlis if he would be willing to increase the janitorial
garbage pickup. Mr. Beratlis indicated he is considering
the possibility of reducing it because there is not that much
of a problem.
The public hearing was closed.
Commissioner Getty indicated that one must be realistic with
regard to putting a two year restriction on the conditional
use permit so that the applicant could get needed financing.
Assistant City Attorney, Brian Swift, indicated that the
matter could be subjected to review in a given period of time
with the understanding that additional conditions could be
imposed if there was a problem concerning parking, litter,
loitering, etc. He indicated that this was done with the
auction on Stanley Boulevard. Commissioner Lindsey felt that
a one year review would be appropriate.
Commissioner Wilson couldn't support the application because
of the lack of parking.
Commissioner Doherty addressed
report and asked how one Could
would not allow consumers to e.
of the business. Commissioner
'immediately' were put between
the problem would be solved.
Condition No. 3 of the staff
enforce a restriction which
~t anywhere they wanted to outside
Lindsey felt that if the word
the word 'premises and outside'
A motion was made by Commissioner Lindsey, seconded by
Commissioner Getty that all required findings necessary to
grant this use permit are made and that case UP-83-16 be
approved subject to the conditions of the staff report, changing
condition number two (2) to reflect that the application shell
only be reviewed in one (1)-year by the Planning Commission and
inserting the word 'immediately' between 'premises' and
'outside' in condition number three (3).
-4-
_. __ _____ ..._. _.. __... .~_ . ., ... _ _ . ___T.. _.._
