MINUTES <br />PLANNING COMMISSION <br />JULY 13, 1983 <br />Page 3 <br />NEW BUSINESS - Public Hearings <br />UP-83-16, Chris Beratlis <br />Application of Chris Beratlis for conditional use permit <br />approval to operate a 940 sq. ft. "take-out" restaurant <br />at 929 "B" Main Street. Zoning for the property is C-C <br />(Central Commercial) District. <br />Mr. Harris presented the staff report recommending approval <br />of the application. <br />Commissioner Wilson asked about the parking standards for <br />this zone and whether or not they included parking for <br />employees. Mr. Harris responded that employee parking is <br />built into the requirements. Commissioner Wilson felt the <br />parking available for this use to be deficient. <br />The public hearing was opened. <br />Mr. Richard Spilier, One Valley, Orinda, addressed the <br />Commission reviewing the type of business he will be <br />conducting at 929 Main Street. He understood the concerns <br />of staff with regard to litter and loiter but indicated he <br />has two similar businesses and has had no problem. He asked <br />that Condition No. 2 be amended because of the capital outlay <br />required to open the business. He indicated that two years <br />would not be sufficient to allow recovery of the investment. <br />He stated that only about 5a of his business in other areas <br />which are near schools are from the students and didn't feel <br />because of the cost of his large burrito ($2.95), loitering <br />with regard to students would be a problem. He further stated <br />student business only represented about 400 of their business <br />hours. <br />Commissioner Wilson asked where all of the customers would park, <br />The applicant responded that much of his business is done <br />by ordering over the telephone and the customer just stops <br />by to pick up their orders. Commissioner Doherty pointed <br />out that there is no parking provided on Main Street in front <br />of this business and if 1000 of the people telephoned their <br />orders in, there wouldn't be sufficient parking. He didn`t, <br />however, feel a two year reapplication should be required. <br />He further stated that mistakes have been made. on other uses <br />in town with regard to parking and could see no reason to <br />duplicate such mistakes on purpose. <br />Commissioner Getty was very happy to see .something like this <br />come into the area. She indicated that both she and Commissioner <br />Lindsey are participating in a task force covering downtown <br />parking to change requirements. <br />Commissioner Lindsey was concerned with loitering and littering <br />and agreed with comments of Commissioner Doherty. <br />-3- <br />._.___......~. ..._..___. ... .. _._. _~ .. ... .... ....... .._.. w.-....._.........._.T..._. ...,..._... .. <br />
